Subpoena services is a special division within our process service department, which exclusively deals with the service process of Subpoena Duces Tecum, Subpoena Ad Testificandum, and Information Subpoenas. Due to the complexities (i.e., Civil Practice laws and rules) related to the service, the process of subpoenas was necessary for this expansion which has allowed us to ensure the accuracy and efficiency of every service.

UNIFORM INTERSTATE DEPOSITIONS AND DISCOVERY ACT

The Uniform Law Commission promulgated the Uniform Interstate Depositions and Discovery Act (UIDDA) in 2007. Under UIDDA, litigants can present a court clerk where discoverable materials are sought with a subpoena issued by a court in the trial state. Once the clerk receives the foreign subpoena, the clerk will issue a subpoena for service upon the person or entity to which the original subpoena is directed. The terms of the issued subpoena must incorporate the same terms as the original subpoena and contain the contact information for all counsel of record and any party not represented by counsel.

The Act requires minimal judicial oversight and eliminates the need to obtain a commission or local counsel in the discovery state, letters rogatory, or filing a miscellaneous action during the discovery phase of litigation. Discovery authorized by the subpoena must comply with the state's rules in which the discovery occurs. In addition, motions to quash, enforce, or modify a subpoena issued pursuant to the Act shall be brought in and governed by the rules of the discovery state. Documents can be faxed at (800) 296-0115, emailed to ps@undisputedlegal.com, mailed, or dropped off at any of our locations. We do require pre-payment and accept all major credit and debit cards. Once payment is processed, your sales receipt is immediately emailed for your records.

Drop-offs must call and make an appointment first to be added to building security to permit access to our office.
