Andorra Process Service

Andorra Process service, also known as "service of process,” is the procedure employed to give appropriate notice of initial legal action to another party (such as a defendant), court, or administrative body in an effort to exercise jurisdiction over that person so as to enable that person to respond to the proceeding before the court, body, or other tribunals. Notice is furnished by delivering a set of court documents (called "process") to the person to be served; a process server performs Andorra process service. Andorra PROCESS SERVERs

Andorra process servers serve civil and commercial matters pursuant to the Hague Service Convention, a multilateral treaty adopted in Hague, Netherlands, on November 15, 1965, by member states of the Hague Conference on Private International Law. It came into existence to give litigants a reliable and efficient means of serving the documents on parties living, operating, or based in another country. The provisions of the convention apply to the service of process in civil and commercial matters but not criminal matters. Also, the Convention shall not apply if the address of the person served with the document is unknown.

Method of Service

Andorra is not a signer of the Hague Service Convention. All demands for service are to be presented to the Principality of Andorra.

Translation Requirements

The Principality of Andorra requires that all demands of service of documents be presented with the formulary of the Convention, which can be downloaded on the Convention page, using either the French/English version or the French/Spanish/English version.

The infinity of variations of documents received in the last 8 or 9 months has obliged us to reflect on the language of notification of the papers; therefore, after consulting the Ministry of Foreign Affairs and the Judicial authorities, the Government of Andorra needs the Secretariat to update information regarding the translation requirement under article 5(3).

The Department of Justice and Interior, acting as the Central authority, is obliged to maintain an updated database where basic information (besides the final designatory and origin) must be entered, and the fact is that many documents or notification demands come with a document, as we said, with no formulary duly filled.

Therefore Andorra will operate like this once the information is online on the web page. If it is essential that we also communicate to the parts of the Convention, please let us know.

The Government of Andorra kindly asks the Secretariat of the HCCH to publish the following information: A) The service requested within the meaning of Article 5(3), sent through the channel of the Central Authority, requires that the original documents arrive accompanied by the translation in Catalan.  B) However, if the DOCUMENT IS SENT DIRECTLY TO THE INTERESTED PARTY/DESTINATARY as the Convention states in (5(2); the documents may be sent in whatever language the requested party considers valid for the interested person to read and fully understand what is sent to them, with their right to accept it or refuse it.

c) The Principality of Andorra declares that, in accordance with Article 8, it is opposed to the service of documents effected directly by the diplomatic or consular agents of the Contracting States on persons who are not nationals of those States.

d) With regard to Article 15, paragraph 2, the Principality of Andorra declares that the judge may give judgment even if no certificate of service or delivery has been received if all the provisions of Article 15, paragraph 2, are fulfilled.

e) With regard to Article 16, paragraph 3, the Principality of Andorra declares that an application for relief will no longer be entertained if it is filed after the expiration of more than one year following the date of the judgment.
