Undisputed Legal Inc. · Version 2026-11.4 · Effective date: October 30, 2026

These Terms and Conditions are a binding agreement between you and Undisputed Legal Inc. They govern every order for services and every use of undisputedlegal.com. Section 12 contains a binding arbitration agreement and a class-action waiver that affect how disputes are resolved; you may opt out of arbitration within 30 days under Section 12.5.

1. Acceptance, parties and definitions

1.1 The parties. “Undisputed Legal,” “we,” “us” and “our” mean Undisputed Legal Inc., a New York corporation with its principal office at One World Trade Center, 85th Floor, New York, NY 10007, which owns and operates the website undisputedlegal.com and any affiliated website we identify. Undisputed Legal Inc. is the contracting party under these Terms. The protections of Sections 9, 10 and 11 extend to its officers, directors, employees, agents, independent contractors, process servers and other authorized providers, each of whom may enforce them. “You” and “Client” mean the person or entity that places an Order or uses the Site.

1.2 Definitions. “Site” means undisputedlegal.com and every page, form and portal on it. “Services” means service of process, document delivery, court filing, subpoena and deposition services, skip tracing, investigation, international service and every other service we offer. “Order” means a request for Services submitted through the Site, the Portal, the Express Pay form, or in person at one of our offices. “Portal” means the client portal on the Site where Orders are tracked and documents are delivered. “Affidavit” means an affidavit, certificate, declaration or proof of service, or a report of attempted or non-service. “Terms” means these Terms and Conditions, version 2026-11.4, including the Privacy Policy and the Disclaimer, which are incorporated by reference.

1.3 How you accept. Sections 6, 7 and 14 are the Website Terms of Use. They are linked from every page of the Site as notice of the conditions on which the Site is offered, and they bind you upon your affirmative acceptance below; a versioned record of that acceptance is kept for every account and transaction. You affirmatively accept the Website Terms of Use, and the rest of these Terms — including the Services terms, the limitation of liability, indemnification and the arbitration agreement in Section 12 — by any one of the following: (a) checking the box marked “I agree to the Terms and Conditions” when you create a Portal account, when you place an Order on the Site, or when you pay through the Express Pay form; (b) signing the acknowledgment presented when you deliver documents in person at one of our offices; or (c) placing an Order by any other means after these Terms have been provided to you in writing. Sections 3, 4, 9 through 13 and the Services terms bind you only upon that affirmative acceptance. We record the version of the Terms you accepted, the date and time, the Order number, and the service level, price and refund conditions shown to you. That record is evidence of your acceptance and is presumed accurate.

1.4 Who may place an Order; authority. You must be at least 18 years old. If you place an Order on behalf of a law firm, company, agency or other entity, you represent that you are authorized to bind it, and “you” includes that entity. You represent that you are authorized to request service, filing, location or investigation of the party named in the Order and to disclose the documents to us, and that each instruction you give us is lawful.

1.5 Changes to these Terms. We may revise these Terms by posting a new version with a new version number and effective date. A revision applies only to Orders placed after its effective date. The version in effect when you placed an Order governs that Order.

1.6 Commercial clients. A law firm, government agency or company may enter into a written engagement letter or master services agreement with us. Where one is signed by an officer of Undisputed Legal, its terms control over these Terms for the Orders it covers, and the parties may agree in it to allocations of risk different from Sections 3, 9, 10 and 12.

2. The Services

2.1 What we provide. We attempt service of legal documents and provide the other Services described on the Site, using the method, the number of attempts and the time frame stated for the service level you select on the Order form. We provide attempts at service and an Affidavit reporting the result. We do not provide, and you are not paying for, a particular outcome.

2.2 No promise of service or outcome. Whether a party can be served depends on facts we do not control, including the accuracy of the address you give us, the party’s whereabouts and conduct, access to the premises, and the requirements of the court. We do not promise or warrant that service will be completed, that a court will accept it, or any result in your legal matter. Fees are earned by the attempts and work performed, whether or not service is completed.

2.3 Service levels. Each service level on the Order form states its first-attempt window in business days or hours, the number of attempts included, and its fee. A first-attempt window runs from the time we receive complete and usable documents and payment, not from the time the Order is placed. Rush and stake-out service, additional addresses, additional attempts beyond those included, mileage outside the stated service area, waiting time, and court filing fees are charged at the rates stated on the Order form or quoted to you in writing before the work is performed.

2.3A What counts as an attempt. An attempt is an actual visit by a process server to an address given in the Order for the purpose of serving the party, including a visit at which no one answers, access to the building or unit is refused or impossible, the party is reported to have moved, or the party is seen but evades. Where the law permits service by a method other than personal delivery (for example, substituted or “nail and mail” service), the steps that method requires are attempts. Each attempt is recorded with its date, time and result, and with GPS location and photographs where the law permits. An attempt counts toward the attempts included in your service level whether or not service is completed. No charge is made for an attempt that did not occur.

2.4 Your responsibilities. You are responsible for: (a) the accuracy and completeness of every name, address, document and instruction you give us; (b) delivering documents that are complete, legible, properly issued and lawful to serve; (c) confirming that service by the method you select satisfies the rules of the court in which your matter is pending; (d) any deadline in your matter, including the time within which service must be made; and (e) using the Services only for a lawful purpose. We may rely on what you give us without independent verification. Work made necessary by an incorrect address, incomplete documents or a changed instruction is charged as a new or additional Order.

2.5 International service. Service outside the United States is performed through the Hague Service Convention, letters rogatory, or the method available in the destination country. The time it takes is set by foreign central authorities and courts and is outside our control; estimates on the Site are estimates only. Fees, translations and foreign official charges are payable in advance and are non-refundable once transmitted abroad.

2.6 Documents. We may retain copies of documents and Affidavits for seven years after the Order to meet our legal and professional obligations. Original documents not required for service are returned at your request within 30 days of the Order or, if not requested, disposed of securely after 90 days.

2.7 Court filing, subpoena domestication and eviction support. When you order court filing, subpoena domestication under the Uniform Interstate Depositions and Discovery Act, or similar legal-support work, we perform the administrative steps you specify: preparing the forms the court requires from the information you provide, presenting documents to the clerk, paying filing fees you have advanced, and reporting the result. You and your attorney remain responsible for the content, sufficiency and legal effect of the documents, for the choice of court and procedure, and for every deadline. A clerk’s rejection of a filing for a deficiency in the documents or information you supplied, or for a requirement of the court outside our control, is not a failure of the Services; correcting and re-presenting the filing is charged as additional work, and court fees are passed through at cost.

2.8 Location and investigation services; permissible purpose. Skip tracing, locates and investigation services use information from public records and from data providers whose terms restrict access to permissible purposes under the Fair Credit Reporting Act, the Driver’s Privacy Protection Act, the Gramm-Leach-Bliley Act and state law. When you order these services you certify the specific lawful purpose for which you request the information, that you will use it only for that purpose, and that you will not disclose it to anyone not entitled to receive it. We may require a written certification, may decline any request that cannot be fulfilled lawfully, and will report a misuse we become aware of as the law requires. You are responsible for your use of the information we provide.

2.9 Our process servers and providers. We perform the Services through our employees and through independent process servers, investigators and other providers we engage, including in jurisdictions where we do not maintain an office. We remain responsible to you for the Services under these Terms, and our providers are bound to confidentiality and to the standards the law of the place of service requires.

3. Orders, fees, cancellation and payment

3.1 Firm orders. An Order is a firm order when it is submitted with payment. Fees are those stated on the Order form at the time of the Order; the Order form is the price list for that Order.

3.2 Cancellation and refunds. You may cancel an Order by written notice to [email protected]. Every Order begins with intake: receiving and reviewing your documents and instructions and setting up the Order in our system. Work begins when we assign the Order to a process server, or begin research, document preparation, filing, translation or transmission abroad, whichever comes first. If we receive your cancellation after intake but before work begins, we refund the fee in full less an intake fee of $35, which is our documented cost of intake and is disclosed at checkout. If we receive it after work begins but before the first attempt, we refund the fee less the intake fee, less the charges for work performed at the rates on the Order form, and less any third-party charges we have incurred, such as court fees, foreign-authority fees, translation and data-provider charges. Once the first attempt has been made, the service fee for that address is earned, except that if you cancel before all the attempts included in your service level have been made, we refund the per-attempt amount stated on the Order form for each included attempt not made. These refund conditions are shown to you before you pay.

3.3 Payment. Payment is due at the time of the Order by the methods offered on the Site. The price shown at checkout is the full price; we do not add a surcharge for any payment method. If a payment is reversed, declined or charged back after work has begun, the full fee remains due, and we may suspend or decline further Services until it is paid.

3.4 Payment disputes. If you dispute a charge with your card issuer or bank, you agree that we may provide the issuer with the Order record, the Affidavit, delivery and communication logs and other records needed to resolve the dispute. This disclosure is limited to that purpose and does not waive the confidentiality that otherwise applies to your matter.

3.5 Collection. Amounts unpaid 30 days after they are due bear interest at 1% per month or the highest rate permitted by law, whichever is less, and you agree to pay our reasonable costs of collection, including attorneys’ fees, to the extent permitted by law.

3.6 Taxes. Fees do not include sales or similar taxes, which are added where required by law.

3.7 Refund when we cannot perform. If we are unable to perform an Order for a reason within our control, we will refund in full the fee paid for the work not performed. That refund is your exclusive remedy for the non-performance and is the full measure of our liability for it under Section 9, subject to Section 9.3.

4. Affidavits and proof of service

4.1 Delivery. We deliver each Affidavit by posting it to your Portal account, by emailing it to the email address on the Order, or both. An Affidavit is delivered at the moment it is posted to the Portal or sent to that email address, whether or not you open, download or read it. For Orders placed in person without a Portal account, an Affidavit is delivered when it is emailed to the address you gave us or, if you gave none, when it is made available for pickup at the office where you placed the Order and we notify you by the telephone number you gave us.

4.2 The record. Our system records the date and time each Affidavit is posted or sent, the account or address it was sent to, and an identifier of the file. That record is evidence of delivery and is presumed accurate; you may rebut the presumption with evidence that the Affidavit was not delivered as the record shows. You are responsible for keeping the email address and telephone number on your account current, and delivery to the address on your account is delivery to you.

4.3 Your review. Review each Affidavit within 30 days after it is delivered and tell us in writing at [email protected] of any error, omission or objection. We correct clerical errors reported within that period at no charge; a clerical correction requested later may carry the fee stated on the Order form. A material error in the facts an Affidavit states will be investigated and corrected whenever it is reported, because an Affidavit must be accurate. To the extent permitted by law, a claim that an Affidavit was not delivered, or was delivered late, is waived unless made in writing within 30 days after the delivery shown in our record.

4.4 Originals and filing. Where a court requires an original or notarized Affidavit, we provide it by mail or courier at the cost stated on the Order form, or file it with the court if you selected court filing. Filing fees charged by a court are passed through to you at cost.

4.5 Non-service. If service is not completed within the attempts included in your service level, we deliver an Affidavit of attempted service or a report of non-service in the same way. Fees for the attempts made are earned and not refundable.

5. Communications and electronic records

5.1 Electronic records and signatures. You consent to receive the Terms, Affidavits, invoices, receipts, notices and all other communications about your Orders electronically, through the Portal and by email, and you agree that electronic records and electronic signatures have the same effect as paper and ink under the federal E-SIGN Act and the Uniform Electronic Transactions Act. To receive electronic records you need a device with internet access, a current web browser, an email account you can access, and software that opens PDF files; by accepting these Terms electronically you confirm that you have them. You may request a paper copy of any Affidavit or record at the cost stated on the Order form. You may withdraw this consent at any time by written notice to [email protected]; withdrawal takes effect for future Orders, does not affect records already delivered, and may mean that some Services are unavailable or carry a paper-handling fee stated on the Order form. Keep the email address on your account current so that electronic records reach you.

5.2 Order communications. We will contact you by email, through the Portal, by telephone and by text message at the number you provide about your Orders and account: confirmations, status updates, questions from our servers, Affidavit delivery and billing. These are service communications, not marketing. Message and data rates may apply to text messages; reply STOP to end text messages about your Orders, in which case we will use email and telephone.

5.3 No marketing by text. We do not send marketing text messages. Any marketing email we send includes an unsubscribe link, and you may unsubscribe at any time without affecting your Orders.

5.4 Orders by email or telephone. If you give us instructions by email, telephone or text, we confirm them by an emailed confirmation or invoice that states the service level, price and refund conditions and links to the version of these Terms then in effect. Your payment of that invoice, or your written reply confirming the Order, is your acceptance of these Terms for that Order, and we keep the confirmation and your acceptance with the Order record in the same way as Section 1.3 describes.

5.5 Call recording. We may record telephone calls with our offices for training, quality and record-keeping. Where the law of your state requires the consent of every party, we announce the recording at the start of the call and continue only with your consent; you may decline, in which case the call is not recorded.

6. No legal advice; no attorney–client relationship

Undisputed Legal is a process-service and legal-support company. We are not a law firm, we are not licensed to practice law, and we do not give legal advice. Nothing we say or publish — on the Site, in an Order, in an Affidavit, or in conversation with our staff — is legal advice, and no attorney–client relationship is created by using the Site or the Services. Information on the Site about statutes, court rules, procedures and forms is general information that may be out of date or may not apply to your matter; you are responsible for confirming the rules of the court in which your matter is pending and for consulting an attorney about your legal rights.

7. Website use and intellectual property

7.1 License and acceptable use. We grant you a limited, revocable, non-exclusive license to use the Site to learn about and order the Services. You may not: copy, republish, scrape, data-mine, frame or create derivative works from the Site or its content; use bots, crawlers or other automated tools to access it, other than search engines indexing public pages; probe, scan or test its security without our written permission; upload malicious code or any file you are not entitled to transmit; share account credentials or use another person’s account; interfere with its operation; attempt to gain unauthorized access to any account, system or data; or collect information about other users. Any use outside this license ends the license, and we may suspend an account that presents a security risk.

7.2 Ownership. The Site and everything on it — text, articles, guides, graphics, logos, page design, software and the name “Undisputed Legal” — are owned by Undisputed Legal Inc. or its licensors and protected by United States and international copyright and trademark law. Other marks on the Site belong to their owners.

7.3 Your account and the Portal. You are responsible for keeping your Portal credentials confidential and for all activity under your account until you tell us it has been compromised. Notify us immediately at [email protected] if you believe your account has been accessed without authorization. We protect the Site and the Portal with the security measures described in the Privacy Policy, and we may take either offline for maintenance or security; an interruption is not a breach of these Terms, and Section 9.5 states the limit of our liability for the Site.

7.4 Your content. You retain ownership of the documents you give us. You grant us the right to copy, store, transmit and file them as needed to perform the Services and to keep the records described in Section 2.6.

8. Disclaimer of warranties

THE SITE AND THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, UNDISPUTED LEGAL DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, AND ANY WARRANTY THAT SERVICE WILL BE COMPLETED, THAT A COURT WILL ACCEPT IT, THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT INFORMATION ON THE SITE IS CURRENT, COMPLETE OR ACCURATE. For New Jersey residents, the implied warranties of merchantability and fitness for a particular purpose are not excluded. Section 13 states each state’s treatment, and nothing in this Section excludes a warranty that the law of your state does not allow to be excluded.

9. Limitation of liability

9.1 Aggregate limit for an Order. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL, CUMULATIVE AND AGGREGATE LIABILITY OF UNDISPUTED LEGAL INC., UNDISPUTEDLEGAL.COM AND THEIR OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, REPRESENTATIVES AND INDEPENDENT CONTRACTORS, COLLECTIVELY, FOR ALL CLAIMS ARISING OUT OF OR RELATING TO AN ORDER OR THE SERVICES PROVIDED UNDER IT, REGARDLESS OF THE NUMBER OF CLAIMS OR LEGAL THEORIES ASSERTED, SHALL NOT EXCEED THE SERVICE FEES ACTUALLY PAID TO UNDISPUTED LEGAL INC. FOR THAT ORDER. THIS LIMIT APPLIES TO CLAIMS IN CONTRACT, ORDINARY NEGLIGENCE, STATUTE OR ANY OTHER THEORY, SUBJECT TO SECTION 9.3 AND TO EVERY RIGHT AND REMEDY THAT APPLICABLE LAW DOES NOT ALLOW TO BE LIMITED.

9.2 Excluded damages. SUBJECT TO SECTION 9.3 AND TO THE MAXIMUM EXTENT PERMITTED BY LAW, UNDISPUTED LEGAL IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST DATA, THE LOSS OR DISMISSAL OF A CLAIM OR CASE, THE LOSS OF A JUDGMENT OR DEFAULT, A MISSED DEADLINE OR LIMITATIONS PERIOD, OR SANCTIONS, EVEN IF ADVISED OF THEIR POSSIBILITY. This exclusion operates independently of Section 9.1 and remains in effect if Section 9.1 is held unenforceable in a particular dispute.

9.3 Application and enforceability of the limitations. The limitations and exclusions in Sections 9.1, 9.2 and 9.5 apply to the fullest extent permitted by applicable law. Nothing in these Terms limits liability or remedies where, and only to the extent that, applicable law prohibits such a limitation, including the consumer-protection rights preserved in Section 13. If any limitation or exclusion is determined to be unenforceable as applied to a particular claim or circumstance, that determination does not affect its enforceability as applied to any other claim or circumstance.

9.4 Basis of the bargain. The fees for the Services reflect this allocation of risk. Without it, the fees would be higher. If you want protection beyond this cap for a particular Order, ask us in writing before placing it; we may agree to a higher limit for an additional fee.

9.5 Claims not tied to an Order. For a claim that does not arise out of an Order — for example, a claim about your use of the Site, the Portal or our communications — the aggregate limit in Section 9.1 is the greater of the fees you paid us in the 12 months before the claim arose and one hundred dollars ($100), subject to Section 9.3.

10. Indemnification

You will defend, indemnify and hold harmless Undisputed Legal Inc., undisputedlegal.com and their officers, directors, employees, agents, independent contractors and representatives (the “Indemnified Parties”) from and against all third-party claims, demands, losses, liabilities, damages, judgments, fines, costs and expenses, including reasonable attorneys’ fees, to the extent caused by: (a) a document, name, address, instruction or other information you provided, including a claim that a document was improperly issued, was unlawful to serve, or was served on the wrong person because of information you gave us; (b) your misrepresentation of your authority or of the purpose of an Order, or a breach of your certification under Section 2.8; (c) your use of the Services, the Site or information we provided for an unlawful purpose or in breach of these Terms; or (d) your legal matter itself, as between you and the person you asked us to serve. This Section does not require you to indemnify an Indemnified Party for its own negligence, gross negligence or willful misconduct. We will notify you promptly of a claim, cooperate at your expense, and allow you to control the defense with counsel reasonably acceptable to us, except that you may not settle a claim in a way that admits fault on our behalf or imposes an obligation on us without our written consent, and we may participate with our own counsel at our cost. This Section survives the completion of the Order.

11. Reservation of remedies; refusal and suspension of service

11.1 Reviews and statements. Nothing in these Terms restricts your right to post an honest review or otherwise comment on the Services, and nothing requires you to keep your experience confidential. Undisputed Legal reserves all remedies available at law for a statement of fact that is false and made with knowledge of its falsity or reckless disregard for the truth.

11.2 Refusal and suspension. We may decline any Order, and may suspend or close an account, when an Order appears to be unlawful, fraudulent, abusive to our staff, or in breach of these Terms, or when a payment is unpaid or reversed. If we decline an Order before any work is performed, we refund the fee paid in full.

12. Dispute resolution

PLEASE READ THIS SECTION CAREFULLY. IT REQUIRES YOU TO ARBITRATE DISPUTES WITH UNDISPUTED LEGAL ON AN INDIVIDUAL BASIS, WAIVES YOUR RIGHT TO SUE IN COURT AND TO A JURY TRIAL, AND WAIVES YOUR RIGHT TO BRING OR JOIN A CLASS ACTION. YOU MAY OPT OUT UNDER SECTION 12.5.

12.1 Notice of claim first. Before starting an arbitration or any permitted court action, the party with a claim must send the other a written notice describing the claim and the relief sought: to us, by mail to Undisputed Legal Inc., Attn: Legal, One World Trade Center, 85th Floor, New York, NY 10007, and by email to [email protected]; to you, at the email and mailing address on your account. The parties will try in good faith to resolve the claim for 30 days after the notice is received. No arbitration or action may be started before those 30 days end.

12.2 Agreement to arbitrate. Except as stated in Sections 12.4 and 12.5, every dispute, claim or controversy between you and Undisputed Legal arising out of or relating to these Terms, an Order, the Services or the Site will be resolved by binding arbitration administered by the American Arbitration Association (AAA), and not in court. If you are an individual ordering for personal, family or household purposes, the AAA Consumer Arbitration Rules and its Consumer Due Process Protocol apply, and any hearing will be held in the county where you reside or by videoconference, at your election. If you are a law firm, business, government agency or other entity, or an individual ordering for business purposes, the AAA Commercial Arbitration Rules apply, and any hearing will be held in New York County, New York, or by videoconference. The Federal Arbitration Act governs this Section. The arbitrator applies the law in Section 12.7, may award any individual relief a court could award, and decides all disputes about the interpretation, applicability and enforceability of this Section, except the question Section 12.3 reserves to a court. If the AAA is unavailable or declines to administer the arbitration, the parties will use JAMS under its comparable rules; if JAMS is also unavailable, a court under Section 12.7 will appoint the arbitrator. Judgment on the award may be entered in any court with jurisdiction.

12.3 Individual claims only; class waiver. Each party may bring claims only in its own individual capacity and not as a plaintiff or class member in any purported class, collective, consolidated or representative proceeding. The arbitrator may not consolidate the claims of different persons or award relief to anyone other than the individual parties. Only a court, not an arbitrator, may decide whether this paragraph is enforceable. If it is found unenforceable as to a particular claim, that claim will proceed in court under Section 12.7 and not in arbitration, and this paragraph remains in effect for every other claim.

12.4 Exceptions. Either party may bring an individual claim in a small-claims court with jurisdiction over it, and may seek an injunction in court to stop unauthorized use of the Site or infringement of intellectual property. A California resident may seek public injunctive relief in court to the extent California law does not allow that remedy to be waived.

12.5 Your right to opt out. You may opt out of Section 12.2 and 12.3 by sending a written notice stating your name, the email address on your account, and “I opt out of arbitration” to the mailing address in Section 12.1 or to [email protected] within 30 days after you first accept these Terms. If you opt out, disputes are resolved in the courts stated in Section 12.7, and you and Undisputed Legal each waive the right to a jury trial to the extent the law permits. Opting out does not affect any other part of these Terms.

12.6 Time to bring a claim. To the maximum extent permitted by applicable law, any claim arising out of or relating to an Order, the Services, the Site or these Terms must be commenced in arbitration or court within one (1) year after the claim accrues, or it shall be permanently barred. Where applicable law prohibits enforcement of this contractual limitations period, the limitations period required by applicable law shall govern.

12.7 Governing law and courts. These Terms and every dispute are governed by the laws of the State of New York, without regard to its conflict-of-laws rules, except that the Federal Arbitration Act governs Section 12 and the laws of your state of residence apply where Section 13 says so. Any claim that is not subject to arbitration will be brought exclusively in the state or federal courts located in New York County, New York, and each party consents to their jurisdiction.

12.8 Fees and costs. Arbitration filing, administrative and arbitrator fees are allocated as the AAA rules that apply under Section 12.2 provide — the Consumer Arbitration Rules for consumer disputes and the Commercial Arbitration Rules for commercial disputes — subject to mandatory law and to any enforceable written agreement between the parties. In any arbitration or court action, the prevailing party is entitled to recover its reasonable attorneys’ fees and costs from the other party to the extent the law permits, except that Undisputed Legal will not seek fees from a consumer whose claim was brought in good faith, and Section 13 states where this paragraph does not apply.

13. State-specific provisions

These provisions apply to a Client who is a consumer resident in the state named, and they control over any conflicting provision of these Terms for that Client. Nothing in these Terms waives a right that the law of your state of residence does not allow to be waived, and any provision that your state’s law makes void does not apply to you.

13.1 New York. Nothing in these Terms limits your rights under New York General Business Law Article 22-A (§ 349 and § 350). The jury waiver in Section 12.5 is knowing and voluntary.

13.2 New Jersey. Nothing in these Terms limits your rights under the New Jersey Consumer Fraud Act. For a New Jersey consumer, the following apply in place of the general provisions: Section 3.5 (interest and collection costs) does not apply; the limitations period in Section 12.6 is two years; Section 12.8 does not entitle Undisputed Legal to recover attorneys’ fees from you; the implied warranties addressed in Section 8 are not excluded; and no provision of these Terms limits our liability for our own negligence beyond what New Jersey law permits. In accordance with the Truth-in-Consumer Contract, Warranty and Notice Act, these Terms identify here and in Section 8 the provisions that do not apply in New Jersey, and any other provision that is void under New Jersey law is inapplicable to New Jersey residents. By agreeing to Section 12 you understand that you are giving up the right to bring a claim in court and to have a jury decide it, and that an arbitrator, not a judge or jury, will decide your dispute.

13.3 Connecticut. Nothing in these Terms limits your rights under the Connecticut Unfair Trade Practices Act. We charge no surcharge for any payment method.

13.4 District of Columbia. Nothing in these Terms limits your rights under the District of Columbia Consumer Protection Procedures Act.

13.5 Texas. Nothing in these Terms waives your rights under the Texas Deceptive Trade Practices–Consumer Protection Act; no waiver of those rights is intended, and any waiver would be effective only if made in the form that Act requires.

13.6 Illinois. Nothing in these Terms limits your rights under the Illinois Consumer Fraud and Deceptive Business Practices Act.

13.7 California. Nothing in these Terms limits your rights under the California Consumers Legal Remedies Act or any other California law that cannot be waived. In accordance with California Civil Code § 1670.8, nothing in these Terms waives your right to make any statement about Undisputed Legal or the Services. Section 12.4 preserves your right to seek public injunctive relief in court. Under California Civil Code § 1789.3, California residents may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs by mail at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.

13.8 Florida. Nothing in these Terms limits your rights under the Florida Deceptive and Unfair Trade Practices Act.

13.9 Other states. If you reside in another state, the rights that its consumer-protection law does not allow to be waived are preserved to the same extent.

14. General provisions and contact

14.1 Entire agreement; order of priority. These Terms, the Order form for each Order, the Privacy Policy and the Disclaimer are the entire agreement between you and Undisputed Legal about the Services and the Site, and replace every earlier agreement or statement about them. If they conflict, a written engagement letter or master services agreement signed by an officer of Undisputed Legal controls for the Orders it covers; the Order form controls as to the service level, price and refund conditions of that Order; and these Terms control as to everything else.

14.2 Severability. If any provision of these Terms is held invalid or unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions remain in full effect, except as Section 12.3 provides.

14.3 No waiver. Our failure to enforce a provision is not a waiver of it or of our right to enforce it later.

14.4 Assignment. You may not assign these Terms or an Order without our written consent. We may assign them to a successor to our business.

14.5 Events beyond our control. We are not liable for delay or failure caused by events beyond our reasonable control, including weather, disaster, epidemic, court or government closure, labor action, utility or internet failure, or the acts of a party being served. Time frames are extended by the duration of the event.

14.6 Survival. Sections 2.2, 2.6, 3.3 through 3.5, 4, 6, 7, 8, 9, 10, 11.1, 12, 13 and 14 survive the completion or cancellation of an Order and the closing of your account.

14.7 Notices. Notices to us go to the addresses in Section 12.1. Notices to you go to the email and mailing address on your account and are effective when sent.

14.8 Interpretation. Headings are for convenience only. “Including” means “including without limitation.” These Terms are in English; a translation is for convenience, and the English text controls.

14.9 No unauthorized commitments; no reliance on oral statements. No employee, process server or contractor of Undisputed Legal may change a fee, waive a provision of these Terms, promise a result, or make any other commitment on our behalf unless an officer of Undisputed Legal confirms it in writing. A statement by our staff about the likely result or timing of service is an estimate, not a promise. You agree that you are not relying on any oral statement, and that only these Terms, the Order form and a writing signed by an officer of Undisputed Legal state what we have agreed to do.
