China Macau Process Service

China Macau Process service, also known as "service of process,” is the procedure employed to give appropriate notice of initial legal action to another party (such as a defendant), court, or administrative body in an effort to exercise jurisdiction over that person to enable that person to respond to the proceeding before the court, body, or other tribunals. Notice is furnished by delivering a set of court documents (called "process") to the person to be served; a process server performs process service. China (Macau) PROCESS SERVERs

China (Macau) process servers serve civil and commercial matters pursuant to the Hague Service Convention, a multilateral treaty adopted in Hague, Netherlands, on November 15, 1965, by member states of the Hague Conference on Private International Law.  It came into existence to give litigants a reliable and efficient means of serving the documents on parties living, operating, or based in another country. The provisions of the convention apply to the service of process in civil and commercial matters but not criminal matters. Also, the Convention shall not apply if the address of the person served with the document is unknown. Click Here for information on the Code of Civil Procedure in China Macau

Method of Service

Upon receiving a request for service, the Central Authority forwards the request to the competent authorities of the Macau Special Administrative Region. Click here for How To Serve Legal Papers in China and Hong Kong.

According to the Civil Procedure Code, service can be made through the registered letter with a reception notice or personal contact of a judicial officer with the addressee.

The service through means of personal contact of a judicial officer with the addressee is only used if the service through means of a registered letter fails. The judicial officer delivers the relevant documents to the addressee. The addressee signs a certificate attesting that the documents have been delivered. In certain cases, the attorney can request he performs that service. The attorney may declare that another person duly registered to render forensic services or another attorney (appointed by the same attorney) will serve the document.

Translation Requirements

According to the declaration made by the People’s Republic of China and the Civil Procedure Code of the Macau Special Administrative Region, the documents to be served in the Macau Special Administrative Region under Art. 5(1) shall be written in either Chinese or Portuguese or be accompanied by a translation in either Chinese or Portuguese.
