Civil Practice Law and Rules § 308 outlines several methods for personal service upon a natural person in New York. These include direct delivery to the individual, delivery to a person of suitable age and discretion at certain locations followed by mailing, delivery to a designated agent, affixing the summons to the door with mailing, and court-directed alternative service when other methods are impracticable.
If direct service is not possible, the summons may be given to a person of suitable age and discretion at the defendant’s business, dwelling, or usual abode. The summons must then also be mailed to the person’s last known residence or actual place of business, and proof of both deliveries must be filed with the court clerk within twenty days.
When using the affix-and-mail method, the process server must affix the summons to the door of the defendant’s actual place of business, dwelling, or usual abode and mail a copy in a ‘personal and confidential’ envelope. Proof of both actions must be filed with the court within twenty days, and service is deemed complete ten days after filing.
Alternative service may be used when other prescribed methods are found to be impracticable. In such cases, the court, upon a motion made without notice, may direct the manner of service to ensure the defendant receives proper notification.
