Service of Process Methods in Tallahassee, Florida

Service of process in Florida is governed by chapter 48 of the Florida Statutes, and the methods below are the routes Florida law authorizes. Under § 48.031(1)(a), “Service of original process is made by delivering a copy of it to the person to be served with a copy of the complaint, petition, or other initial pleading or paper or by leaving the copies at his or her usual place of abode with any person residing therein who is 15 years of age or older and informing the person of their contents.” § 48.031(1)(b) provides that “An employer, when contacted by an individual authorized to serve process, shall allow the authorized individual to serve an employee in a private area designated by the employer.” Substituted service on the spouse of the person to be served is available under § 48.031(2)(a) where the conditions that subsection sets are met. On who may serve, § 48.021(1) provides: “All process shall be served by the sheriff of the county where the person to be served is found, except nonenforceable civil process, criminal witness subpoenas, and criminal summonses may be served by a special process server appointed by the sheriff as provided in this section or by a certified process server as provided in s. 48.27.” Undisputed Legal performs service through process servers holding the office that § 48.27 or § 48.021 requires for the assignment.

Service on a corporation. Under § 48.081(2), “A domestic corporation or registered foreign corporation may be served with process required or authorized by law by service on its registered agent designated by the corporation under chapter 607 or chapter 617, as applicable.” Where the registered agent cannot be served, § 48.081(3) sets out a sequence of other persons on whom process may then be served, and § 48.081(4) provides for service on the Secretary of State as provided in § 48.161 or by order of the court under § 48.102. Service on a limited liability company. Under § 48.062(2), an LLC “may be served with process required or authorized by law by service on its registered agent designated by the domestic limited liability company or registered foreign limited liability company under chapter 605.” Where the registered agent cannot be served after one good faith attempt, § 48.062(3) permits service on a manager of a manager-managed company, a member of a member-managed company, or a person listed publicly on the latest annual report. § 48.062(4) then provides that, after due diligence and where its conditions are met, “the service of process may be served as provided in s. 48.161 on the Secretary of State as an agent of the domestic limited liability company or the registered foreign limited liability company or by order of the court under s. 48.102.” The section continues beyond that subsection, and the statute itself should be consulted for the routes it sets out.

Service outside Florida, and proof of service. Under § 48.194(1), “service of process on a party in another state, territory, or commonwealth of the United States must be made in the same manner as service within this state by any person authorized to serve process in the state where service shall be made. No order of court is required.” The same subsection ties service to its proof: “A return-of-service form described in s. 48.21, or any other competent evidence, must be filed with the court stating the time, manner, and place of service.” § 48.21(1) sets what that form must record — the date and time when the process comes to hand, the date and time when it is served, the manner of service, the name of the person on whom it was served, and, if served in a representative capacity, the position that person occupies — and requires the form to list all pleadings and documents served and to be signed by the person who effects service.

After Service in Tallahassee, Florida: Proof and Filing of the Return

Chapter 48 sets out what must be recorded, signed and filed after process is served in Florida. The statutes call the document a return-of-service form; in common commercial practice the same record is often called an affidavit of service.

What the return must state. Section 48.21(1) provides that each person who effects service notes on the return-of-service form the date and time the process came to hand, the date and time it was served, the manner of service, the name of the person served and, where service is in a representative capacity, the position that person occupies. The form lists all pleadings and documents served and is signed by the person who effected service; a person authorized under chapter 48 may sign using an electronic signature.

Marking and filing. Section 48.031(5) provides that the server places the date and time of service, initials or signature and, if applicable, identification number on the first page of at least one of the processes served, and that the person requesting service or the person authorized to serve it files the return-of-service form with the court.

If the return is incomplete. Section 48.21(2) provides that a failure to state the facts or include the signature invalidates the service, that the return is amendable at any time on application to the court from which the process issued, and that on amendment service is as effective as if the return had originally been complete. Such a failure subjects the person effecting service to a fine not exceeding $10, in the court’s discretion.

Additional requirements for certified process servers

Section 48.29(6) provides that a certified process server places the information required in section 48.031(5) on the first page of at least one of the processes served and makes return on a form reviewed and approved by the court. Section 48.31(2) provides that a certified process server must be disinterested, and that one who willfully and knowingly executes a false return of service is guilty of a felony of the third degree and is permanently barred from serving process in this state.

What these sections do not address. Neither section 48.21 nor section 48.031(5) states a deadline for filing the return-of-service form. Filing deadlines and mechanics are governed by court rule, which is outside the scope of this description. These provisions are stated as they appear in the 2026 Florida Statutes.

Stat. § 35.02. Appeals from Leon County therefore proceed to the First District Court of Appeal, which under Fla. Stat. § 35.05(1) is headquartered “in the Second Judicial Circuit, Tallahassee, Leon County.”
