The Uniform Interstate Depositions and Discovery Act (UIDDA) is model legislation that has been adopted by forty states since its creation in 2007. It simplifies the process of issuing subpoenas for discovery in cases brought in another state, whether a party is seeking discovery via a deposition, the production of documents, or other inspections. In Ohio, the UIDDA supersedes Ohio Rev. Code 2319.09, which previously governed discovery in foreign jurisdictions.
At Undisputed Legal, we have mastered the intricacies of the Uniform Interstate Deposition and Discovery Act in Ohio for domesticating foreign subpoenas. Our team of experienced professionals ensures that when a properly issued out-of-state subpoena is received, we follow the streamlined process set forth by UIDDA Ohio to obtain the necessary discovery efficiently and cost-effectively. We handle the domestication and service of process under UIDDA Ohio, allowing our clients to focus on building their case.
To ensure compliance with Ohio Rules of Civil Procedure 45, Undisputed Legal encourages petitioners to utilize the subpoena(s) provided by the Clerk’s office. If a process server is to be used, they must have a request for service of process and a proposed order from the court appointing the process server, which must be authorized and signed by a judge of the court.
Upon receipt of the UIDDA Ohio documents, the clerk’s office will issue a miscellaneous case number. The court clerk will then promptly issue the subpoena for service on the person it is addressed to, following any UIDDA Ohio rule of court or legislation related to serving the subpoena. If the subpoena is to be served by a process server, it must be picked up from the Clerk of Courts. It is important to note that a witness cannot be compelled to appear for a deposition in another jurisdiction.
Undisputed Legal’s experienced team ensures that all UIDDA Ohio requirements are met, minimizing the risk of delays or complications in the domestication process.
Before the implementation of UIDDA Ohio, the procedures an attorney had to follow to obtain evidence or testimony crucial to an action filed in a different state court varied significantly from state to state. Under the Uniform Foreign Depositions Act, a party from outside of Ohio seeking discovery in an Ohio court had to first obtain “any mandate, writ, or commission” from a court of record in the state where the litigation was proceeding. This process required the assistance of an attorney licensed in Ohio, as only Ohio-licensed attorneys could represent the individual.
However, with the adoption of UIDDA Ohio, it is no longer necessary to file a separate action in Ohio to comply with a subpoena issued by a trial court in another state. Under UIDDA Ohio, a party from another state needing to conduct discovery in Ohio must produce a subpoena issued by their home state’s trial court to an Ohio Clerk of Court. The Ohio clerk must then swiftly issue the requested subpoena under the jurisdiction of the Ohio court, incorporating the terms of the out-of-state subpoena. Since compliance with a UIDDA subpoena does not constitute an appearance in an Ohio court, the presence of an Ohio-licensed attorney is not required.
UIDDA Ohio also makes it easier and more cost-effective for Ohio attorneys to depose individuals residing in other states and collect discoverable materials outside of Ohio, as subpoenas issued by an Ohio trial court are now recognized in other jurisdictions that have adopted the UIDDA.
It is important to note that UIDDA Ohio does not affect a party’s ability to seek a protective order or to enforce, quash, or modify a subpoena in the court of the county where discovery occurs, as provided in the Ohio Rules of Civil Procedure. If an out-of-state party wishes to have the subpoena enforced in an Ohio court, they would need to be represented by an attorney licensed to practice law in Ohio.
Undisputed Legal’s team of experts is well-versed in navigating the interplay between UIDDA Ohio and the Ohio Rules of Civil Procedure, ensuring that our clients’ rights are protected and that any necessary motions are filed in a timely manner.
Under UIDDA Ohio, subpoenas need not be issued by the Clerk’s Office or under the Court’s seal. Instead, the rule grants attorneys, as “officers of the court,” the authority to sign and issue subpoenas. The Clerk’s Office will provide a party with a subpoena that has been signed but is otherwise blank, and the party seeking the subpoena is responsible for completing it before it can be served. For any party who is not an officer of the Court, the subpoena must be signed by the Clerk’s Office.
Attorneys may issue subpoenas in the name of the court where they are admitted to practice or, if the deposition is being conducted in another district, in the name of that court. If the attorney is licensed to practice in the district where the original action was filed, they are not required to be a bar member or admitted pro hac vice in the district where the subpoena is issued.
Unless a dispute arises or the Court orders otherwise, there is no need to file proof of service with the Clerk. In cases where this is required, the subpoena should be filed with the court that originally issued it.
Undisputed Legal’s experienced team ensures that all subpoenas issued under UIDDA Ohio comply with these requirements, minimizing the risk of delays or complications in the domestication process.
To assist attorneys in domesticating a foreign subpoena in Ohio, Undisputed Legal provides a sample subpoena that complies with UIDDA Ohio requirements:
[Subpoena Form]-Franklin County
[Subpoena Form]-Cuyahoga County
This sample subpoena includes all the necessary information required by UIDDA Ohio, such as the incorporation of the terms used in the foreign subpoena and the names, addresses, and telephone numbers of all counsel of record and unrepresented parties. By utilizing this sample and entrusting Undisputed Legal with the process, attorneys can ensure a smooth and efficient experience when domesticating a foreign subpoena in Ohio.
When legal counsel requests that the Clerk’s Office issue a subpoena for a deposition in a foreign country, they must provide an original, attorney-signed Notice of Deposition with an accompanying Certificate of Service, if required by the Clerk’s Office.
To file a motion to quash a subpoena, a filing fee of $47.00 and a “miscellaneous number” are necessary. To issue a foreign subpoena, the filing party must submit a subpoena issued from a foreign court and a completed Rule 45 Subpoena from the Cuyahoga County Court of Common Pleas, leaving the case number and judge fields blank. The subpoenas must be filed in person or by mail. Upon receipt of these items, a civil case number is assigned, and the subpoena is promptly issued. The filing party is responsible for service in accordance with UIDDA Ohio. While no filing fee is required, any costs associated with the subpoena will be billed.
Undisputed Legal’s extensive knowledge of these procedures ensures that our clients can effectively obtain out-of-state deposition subpoenas in Ohio while fully complying with all applicable laws and regulations.
