Serbia Process Service

Serbia Process service, also known as "service of process,” is the procedure employed to give appropriate notice of initial legal action to another party (such as a defendant), court, or administrative body in an effort to exercise jurisdiction over that person to enable that person to respond to the proceeding before the court, body, or other tribunals. Serbia PROCESS SERVERs

Serbia process servers serve civil and commercial matters pursuant to the Hague Service Convention, a multilateral treaty adopted in Hague, Netherlands, on November 15, 1965, by member states of the Hague Conference on Private International Law.  It came into existence to give litigants a reliable and efficient means of serving the documents on parties living, operating, or based in another country. The provisions of the convention apply to the service of process in civil and commercial matters but not criminal matters. Also, the Convention shall not apply if the address of the person served with the document is unknown.

Method of Service

In accordance with the Civil Procedure Act, the incoming requests are executed as follows:

The Court summons the party for service of documents.  If the party does not appear before the Court, the document is sent to the party through the Post.

Translation Requirements

Service by Mail

Service by mail is possible only in states that have not objected to that method under Article 10(a) of the convention and if the jurisdiction where the court case takes place allows it under its applicable law.

In accordance with Article 21 of the Convention, the Republic of Serbia declares:
a) Way of service prescribed by paragraph 1 of Article 5 of the Convention will be applied in the Republic of Serbia if an official translation accompanies the document(s) for which its service is requested into Serbian.
b) Receipt on delivery prescribed by Article 6 of the Convention in the Republic of Serbia makes the Competent Court competent for service of the document(s).
c) the Republic of Serbia is against directly documenting service on its territory performed by foreign diplomatic or consular Representatives in accordance with Article 8 of the Convention, except if the Recipient is a Citizen of a diplomatic or consular Representative's Country.
d) the Republic of Serbia is against the way of service (delivery) prescribed in Articles 10 a) and c) of the Convention.
e) the Republic of Serbia declares that all Courts in the Republic of Serbia can pronounce verdicts if all conditions are fulfilled in accordance with paragraph 2 of Article 15 of the Convention.
f) the Republic of Serbia declares that the Request for return to the previous state prescribed in Article 16 of the Convention will be rejected as unallowed if submitted after the expiration of one year from the day of pronouncing of the verdict.
