Service of Process Methods in Miami-Dade County, Florida

Service of process in Florida is governed by chapter 48 of the Florida Statutes. The methods below are the routes Florida law authorizes. Undisputed Legal performs service through process servers holding the office that § 48.27 or § 48.021 requires for the assignment.

  • Personal service — Under § 48.031(1)(a), service of original process is made by delivering a copy of it to the person to be served, together with a copy of the complaint, petition, or other initial pleading or paper.
  • Substitute service at the usual place of abode — The same paragraph authorizes leaving the copies at the person’s usual place of abode with any person residing therein who is 15 years of age or older, and informing that person of their contents.
  • Substituted service on a spouse§ 48.031(2)(a) permits substituted service on the spouse of the person to be served, at any place in a county, where the cause of action is not an adversarial proceeding between them, the spouse requests such service or is also a party, and the spouse and the person to be served reside together in the same dwelling.
  • Service at a place of employment§ 48.031(1)(b) requires an employer, when contacted by an individual authorized to serve process, to allow that individual to serve an employee in a private area designated by the employer.
  • Service on a corporation§ 48.081(2) directs service to the registered agent designated under chapter 607 or chapter 617. Where the registered agent cannot be served after one good faith attempt, § 48.081(3) permits service on the chair of the board of directors, the president, any vice president, the secretary, or the treasurer, or on any person listed publicly on the latest annual report; and § 48.081(4) provides for service on the Secretary of State as provided in § 48.161, or by order of the court under § 48.102, after due diligence.
  • Service on a limited liability company§ 48.062(2) directs service to the registered agent designated under chapter 605. Where the registered agent cannot be served after one good faith attempt, § 48.062(3) permits service on any manager of a manager-managed company, any member of a member-managed company, or any person listed publicly on the latest annual report. The limited liability company cascade ends there; the corporation cascade continues to the Secretary of State and to court order under § 48.081(4).
  • Service outside Florida§ 48.194(1) provides that service on a party in another state, territory, or commonwealth of the United States is made in the same manner as service within Florida, by any person authorized to serve process in the state where service is made, and that no order of court is required. A return-of-service form described in § 48.21, or other competent evidence, must be filed with the court.

Who may serve. Under § 48.021(1), all process is served by the sheriff of the county where the person to be served is found, except that nonenforceable civil process, criminal witness subpoenas, and criminal summonses may be served by a special process server appointed by the sheriff or by a certified process server as provided in § 48.27. A special process server is appointed by the sheriff and, under § 48.021(3), is authorized to serve process only in the county in which the appointing sheriff resides. A certified process server is designated by the chief judge of a judicial circuit and, under § 48.27(2)(a), is authorized to serve initial nonenforceable civil process on a person found within the circuit where that server is certified. § 48.27(3) preserves service by the sheriff and a deputy, and preserves appointment by individual motion and order under Rule 1.070(b) of the Florida Rules of Civil Procedure.

In Miami-Dade County these two territories coincide. § 26.021(11) composes the Eleventh Judicial Circuit of Miami-Dade County alone, so a circuit-wide certification under § 48.27 and a county-wide appointment under § 48.021 describe the same ground here. That equivalence follows from a single-county circuit and does not hold in a circuit composed of more than one county.

After Service in Miami-Dade County: Proof and Filing of the Return

Florida law calls the record of service a return-of-service form; in commercial practice the same record is often called an affidavit of service. § 48.21 sets out what that form must contain and who must sign it.

  • What the return must state — Under § 48.21(1), the person who effects service notes on the form the date and time when the process comes to hand, the date and time when it is served, the manner of service, the name of the person on whom it was served, and, where a person is served in a representative capacity, the position that person occupies.
  • What the return must list — The same subsection requires the form to list all pleadings and documents served.
  • Who signs it§ 48.21(1) requires the form to be signed by the person who effects the service of process, and expressly permits a person authorized under chapter 48 to sign using an electronic signature.
  • Filing for out-of-state service§ 48.194(1) provides that a return-of-service form described in § 48.21, or any other competent evidence, must be filed with the court stating the time, manner, and place of service.
  • A defective return is curable§ 48.21(2) provides that a failure to state the facts or to include the signature invalidates the service, but that the return is amendable to state the facts or include the signature at any time on application to the court from which the process issued, and that on amendment service is as effective as if the return had originally stated the omitted facts or included the signature.

Miami is located in Miami-Dade County. Under Fla. Stat. § 26.021(11), the eleventh circuit is composed of Miami-Dade County, so the trial court of general jurisdiction is the Eleventh Judicial Circuit of Florida, which operates eleven court facilities across the county. Under Fla. Stat. § 34.01(1)(c)3., county court jurisdiction extends to actions at law in which the matter in controversy does not exceed $50,000, exclusive of interest, costs, and attorney fees, for actions filed on or after January 1, 2023; civil matters above that threshold, and those within the circuit court’s exclusive jurisdiction, are heard in the Eleventh Judicial Circuit.

Appeals follow a two-step statutory path rather than a single county-to-court rule. Miami-Dade sits in the Eleventh Judicial Circuit under § 26.021(11), and the Third Appellate District is in turn composed of the Eleventh and Sixteenth Judicial Circuits under Fla. Stat. § 35.04. Appeals from Miami-Dade therefore proceed to the Third District Court of Appeal, 2001 S.W. 117th Avenue, Miami, FL 33175. Under Fla. Stat. § 35.05(1), that District is headquartered in the Eleventh Judicial Circuit, Miami-Dade County.

Federal matters arising here fall within the Southern District of Florida. 28 U.S.C. § 89(c) provides that “The Southern District comprises the counties of Broward, Dade, Highlands, Indian River, Martin, Monroe, Okeechobee, Palm Beach, and St. Lucie,” and that “Court for the Southern District shall be held at Fort Lauderdale, Fort Pierce, Key West, Miami, and West Palm Beach.” The statute lists the county as “Dade”; it is styled Miami-Dade today.

Filings are received by the Clerk of the Court and Comptroller of Miami-Dade County, 20 NW 1st Avenue, Miami, Florida 33128, 305-275-1155. Electronic filing runs through the statewide Florida Courts e-Filing Portal, through which the Clerk receives filings.
