Service of Process Methods in Goshen, Augusta

Process service in Goshen, Augusta is governed by O.C.G.A. § 9-11-4, the process section of the Georgia Civil Practice Act, quoted here from Justia’s republication of the 2025 Official Code of Georgia Annotated, the Code published for the State by LexisNexis. Under subsection (a), “Upon the filing of the complaint, the clerk shall forthwith issue a summons and deliver it for service.” Under subsection (b), “The summons shall be signed by the clerk; contain the name of the court and county and the names of the parties; be directed to the defendant.” Subsection (c) names who may serve: “Process shall be served by:” (1) “The sheriff of the county where the action is brought or where the defendant is found or by such sheriff’s deputy;” (2) “The marshal or sheriff of the court or by such official’s deputy;” (3) “Any citizen of the United States specially appointed by the court for that purpose;” (4) “A person who is not a party, not younger than 18 years of age, and has been appointed by the court to serve process or as a permanent process server;” or (5) “A certified process server as provided in Code Section 9-11-4.1.” In Richmond County the summons issues from the Clerk of Superior, State & Juvenile Court — one office for three courts, by its own title — whose letter of February 23, 2015 states that “Effective February 23, 2015, Richmond County Superior Court will accept electronically filed documents in general civil and domestic relations cases.” and that “Filing fees and costs are processed electronically through PeachCourt at the time of filing.”; no court filing cost was read from any permitted body when this page was composed, the courts’ own schedules sitting on a site that was not reachable. Under O.C.G.A. § 9-11-4(c) Superior Court process is served by the Richmond County Sheriff, whose Civil Division states that “The Civil Division is tasked with the responsibility of serving civil processes received from the Courts of Richmond County, as well as other jurisdictions.” that “Civil Division deputies serve subpoenas and summons to individuals, corporations, or other entities in the county in accordance with the Georgia Rules of Civil Procedure.” and that “For civil processes other than Protective orders there is a service fee of $50.00.” and gives its telephone and hours: “For information about having your documents served, call the Civil Division at 706-821-1444 Monday-Friday, 8:30a.m. until 5p.m.” Our work in Augusta is the service subsection (c) opens to a private server: personal service, the skip trace that locates the defendant, and the documented record of every attempt. The methods are these:

  • Personal Service — Subsection (e) provides that “Except for cases in which the defendant has waived service, the summons and complaint shall be served together.” “The plaintiff shall furnish the clerk of the court with such copies as are necessary.” “Service shall be made by delivering a copy of the summons attached to a copy of the complaint as follows:” and the subsection then sets out, party by party, the person to whom the copy is delivered.
  • Service on a Corporation — Under subsection (e)(1)(A), service on a corporation incorporated or domesticated in Georgia, or a foreign corporation authorized to transact business here, is made “to the president or other officer of such corporation or foreign corporation, a managing agent thereof, or a registered agent thereof,” with the Secretary of State an agent for service when service cannot be had in that manner.
  • Service by Publication — Subsection (f)(1) provides for publication “When the person on whom service is to be made resides outside the state, or has departed from the state, or cannot, after due diligence, be found within the state, or conceals himself or herself to avoid the service of the summons,” on affidavit to the satisfaction of the judge or clerk; then “the judge or clerk may grant an order that the service be made by the publication of summons.”
  • Gated and Secured Communities — Subsection (f)(4) opens gated and secured communities to a person authorized to serve process who identifies the party to be served and displays identification and evidence of appointment; “Any person authorized to serve process shall promptly leave gated and secured communities upon perfecting service of process or upon a determination that process cannot be effected at that time.”
  • Waiver of Service — Subsection (d) provides that “A defendant who waives service of a summons does not thereby waive any objection to the venue or to the jurisdiction of the court over the person of the defendant.” Defendants of the classes it names “have a duty to avoid unnecessary costs of serving the summons,” and a request for waiver allows “at least 30 days from the date on which the request is sent, or 60 days from that date if the defendant is addressed outside any judicial district of the United States”; where a defendant within the United States fails to comply without good cause, “the court shall impose the costs subsequently incurred in effecting service on the defendant unless good cause for the failure is shown.”
  • Territorial Limits and Cumulative Methods — Subsection (g) provides that “All process may be served anywhere within the territorial limits of the state and, when a statute so provides, beyond the territorial limits of the state.” and subsection (j) that “The methods of service provided in this Code section are cumulative and may be utilized with, after, or independently of other methods of service.”

After Service in Goshen, Augusta: The Return of Service and Its Filing

O.C.G.A. § 9-11-4 sets out what is recorded and filed after process is served in Goshen, Augusta. The statute speaks of the server’s proof of service; in common commercial practice the same record is called an affidavit of service.

The return and its time limit. Subsection (h) provides that “The person serving the process shall make proof of such service with the court in the county in which the action is pending within five business days of the service date.” “If the proof of service is not filed within five business days, the time for the party served to answer the process shall not begin to run until such proof of service is filed.”

The form of the proof. “Proof of service shall be as follows:” (1) “If served by a sheriff or marshal, or such official’s deputy, the affidavit or certificate of the sheriff, marshal, or deputy;” (2) “If by any other proper person, such person’s affidavit;” (3) “In case of publication, the certificate of the clerk of court certifying to the publication and mailing;” or (4) “The written admission or acknowledgment of service by the defendant.” In the case of service otherwise than by publication, “the certificate or affidavit shall state the date, place, and manner of service.”

Amendment. Subsection (i) provides that “At any time in its discretion and upon such terms as it deems just, the court may allow any process or proof of service thereof to be amended, unless it clearly appears that material prejudice would result to the substantial rights of the party against whom the process issued.”

Filing. The proof of service is filed with the court in the county in which the action is pending. For the Superior Court of Richmond County that office is the Clerk of Superior, State & Juvenile Court, by its own title, and its own site was not reachable when this page was composed. The Clerk stated on February 23, 2015 that “Effective February 23, 2015, Richmond County Superior Court will accept electronically filed documents in general civil and domestic relations cases.” and that “e-Filing is optional and is an alternative to filing printed documents by hand.”; a later e-filing rule, if any, was not read.

Area Courts for Goshen, Augusta

Goshen lies in Augusta, Richmond County, Georgia — one consolidated government, “Augusta-Richmond County, Georgia” in the Clerk of Court’s own letterhead — whose courts sit in three tiers: the county courts of Richmond County, the statewide appellate courts under the Supreme Court of Georgia, and the federal courts for the Southern District of Georgia, whose Augusta Division 28 U.S.C. § 90(c)(1) holds at Augusta. Which court a matter belongs to determines where papers are filed and served; the courts below publish their own sites for filing procedures, locations and rules, and the Local Court Information below carries the detail for Goshen.

  • The Richmond County courts — The Superior Court of Richmond County is the county’s trial court of general jurisdiction, sitting in the Augusta Judicial Circuit: the Augusta Bar Association states that “The Superior Court is Georgia’s only general jurisdiction trial court with exclusive, constitutional authority over felony cases, divorce, equity, and cases regarding title to land.” that “The Superior Court of the Augusta Judicial Circuit is comprised of BURKE COUNTY; COLUMBIA COUNTY; and RICHMOND COUNTY.” and that “The Superior Court also corrects errors made by lower courts, but decisions by some lower courts and governmental bodies also can be appealed to Superior Court.” (a bar association’s words about the court; the link is the Bar’s own anchor for the court, and its own site was not reachable when this page was composed). Its Clerk, the Clerk of Superior, State & Juvenile Court, stated on February 23, 2015 that “Effective February 23, 2015, Richmond County Superior Court will accept electronically filed documents in general civil and domestic relations cases.” and that “e-Filing is optional and is an alternative to filing printed documents by hand.” The State Court of Richmond County, named beside the Superior Court in the Clerk’s title, is a court of the class the Council of State Court Judges describes — “State Courts are the highest level of county-supported trial court in the State’s judicial branch of government.” — and its own site was not reachable when this page was composed; no civil ceiling was read. The Probate Court of Richmond County and the Richmond County Juvenile Court complete the county’s courts named by the bodies read; for each of them, its own site was not reachable when this page was composed.
  • The statewide appellate courts — Appeals from the Richmond County courts lie to the Court of Appeals of Georgia, which the Judicial Council’s Gateway describes in one sentence: “The Court of Appeals is the intermediate appellate court.” (the link is the Gateway’s own anchor; the court’s site answered the instrument with a method refusal when this page was composed). Above it sits the Supreme Court of Georgia, whose Clerk’s office the Court describes as “The Clerk’s office of the Supreme Court of Georgia is the public office of the Court.”
  • The federal courts — Richmond County lies in the Augusta Division of the Southern District of Georgia, for which 28 U.S.C. § 90(c)(1) provides that “(1) The Augusta Division comprises the Counties of Burke, Columbia, Glascock, Jefferson, Lincoln, McDuffie, Richmond, Taliaferro, Warren, and Wilkes. Court for the Augusta Division shall be held at Augusta.”: the United States District Court for the Southern District of Georgia sits at Augusta — “The U.S. District Court is comprised of 6 divisions encompassing 43 counties in the State of Georgia.” — stating “Street Address: 600 James Brown Blvd. Augusta, GA 30901 Clerk’s Office 706-849-4400” (its Augusta page states no hours), and the United States Bankruptcy Court for the Southern District of Georgia, which states “We serve 43 counties in southeast Georgia with offices in Augusta, Brunswick, Dublin, Savannah, Waycross, and Statesboro.” keeps its Augusta office at “Street Address: U.S. Bankruptcy Court Federal Justice Center 600 James Brown Blvd Augusta, GA 30901 (706) 823-6000 Mailing Address: U.S. Bankruptcy Court PO Box 1487 Augusta, GA 30903” (“Clerk’s Office Hours of Operation: Monday through Friday, 8:30 AM to 5:00 PM”). Appeals lie to the United States Court of Appeals for the Eleventh Circuit — in its own words “Established by Congress in 1981, the United States Court of Appeals for the Eleventh Judicial Circuit has jurisdiction over federal cases originating in the states of Alabama, Florida and Georgia.”

The area is characterized by both established homes and newer subdivisions, which can present challenges in locating individuals or gaining entry to private complexes. Additionally, Augusta’s broader urban environment includes commercial corridors and proximity to major roadways, necessitating familiarity with local traffic patterns and neighborhood layouts.
