Service of Process Methods in Georgia

Service of a summons and complaint in a civil action in the superior court of each of Georgia’s 159 counties is governed by O.C.G.A. § 9-11-4, the process section of the Georgia Civil Practice Act, quoted here from Justia’s republication of the 2025 Official Code of Georgia Annotated, the Code published for the State by LexisNexis. Under subsection (a), “Upon the filing of the complaint, the clerk shall forthwith issue a summons and deliver it for service.” Under subsection (b), “The summons shall be signed by the clerk; contain the name of the court and county and the names of the parties; be directed to the defendant.” Subsection (c) names who may serve: “Process shall be served by:” (1) “The sheriff of the county where the action is brought or where the defendant is found or by such sheriff’s deputy;” (2) “The marshal or sheriff of the court or by such official’s deputy;” (3) “Any citizen of the United States specially appointed by the court for that purpose;” (4) “A person who is not a party, not younger than 18 years of age, and has been appointed by the court to serve process or as a permanent process server;” or (5) “A certified process server as provided in Code Section 9-11-4.1.” Our work across Georgia is the service subsection (c) opens to a private server: personal service, the skip trace that locates the defendant, and the documented record of every attempt. The methods are these:

  • Personal Service — Subsection (e) provides that “Except for cases in which the defendant has waived service, the summons and complaint shall be served together.” “The plaintiff shall furnish the clerk of the court with such copies as are necessary.” “Service shall be made by delivering a copy of the summons attached to a copy of the complaint as follows:” and the subsection then sets out, party by party, the person to whom the copy is delivered.
  • Service on a Corporation — Under subsection (e)(1)(A), service on a corporation incorporated or domesticated in Georgia, or a foreign corporation authorized to transact business here, is made “to the president or other officer of such corporation or foreign corporation, a managing agent thereof, or a registered agent thereof,” with the Secretary of State an agent for service when service cannot be had in that manner.
  • Service by Publication — Subsection (f)(1) provides for publication “When the person on whom service is to be made resides outside the state, or has departed from the state, or cannot, after due diligence, be found within the state, or conceals himself or herself to avoid the service of the summons,” on affidavit to the satisfaction of the judge or clerk; then “the judge or clerk may grant an order that the service be made by the publication of summons.”
  • Gated and Secured Communities — Subsection (f)(4) opens gated and secured communities to a person authorized to serve process who identifies the party to be served and displays identification and evidence of appointment; “Any person authorized to serve process shall promptly leave gated and secured communities upon perfecting service of process or upon a determination that process cannot be effected at that time.”
  • Waiver of Service — Subsection (d) provides that “A defendant who waives service of a summons does not thereby waive any objection to the venue or to the jurisdiction of the court over the person of the defendant.” Defendants of the classes it names “have a duty to avoid unnecessary costs of serving the summons,” and a request for waiver allows “at least 30 days from the date on which the request is sent, or 60 days from that date if the defendant is addressed outside any judicial district of the United States”; where a defendant within the United States fails to comply without good cause, “the court shall impose the costs subsequently incurred in effecting service on the defendant unless good cause for the failure is shown.”
  • Territorial Limits and Cumulative Methods — Subsection (g) provides that “All process may be served anywhere within the territorial limits of the state and, when a statute so provides, beyond the territorial limits of the state.” and subsection (j) that “The methods of service provided in this Code section are cumulative and may be utilized with, after, or independently of other methods of service.”

After Service in Georgia: The Return of Service and Its Filing

O.C.G.A. § 9-11-4 sets out what is recorded and filed after process is served. The statute speaks of the server’s proof of service; in common commercial practice the same record is called an affidavit of service.

The return and its time limit. Subsection (h) provides that “The person serving the process shall make proof of such service with the court in the county in which the action is pending within five business days of the service date.” “If the proof of service is not filed within five business days, the time for the party served to answer the process shall not begin to run until such proof of service is filed.”

The form of the proof. “Proof of service shall be as follows:” (1) “If served by a sheriff or marshal, or such official’s deputy, the affidavit or certificate of the sheriff, marshal, or deputy;” (2) “If by any other proper person, such person’s affidavit;” (3) “In case of publication, the certificate of the clerk of court certifying to the publication and mailing;” or (4) “The written admission or acknowledgment of service by the defendant.” In the case of service otherwise than by publication, “the certificate or affidavit shall state the date, place, and manner of service.”

Amendment. Subsection (i) provides that “At any time in its discretion and upon such terms as it deems just, the court may allow any process or proof of service thereof to be amended, unless it clearly appears that material prejudice would result to the substantial rights of the party against whom the process issued.”

Filing. The proof of service is filed with the court in the county in which the action is pending.

  • The superior courts — the trial courts of general jurisdiction, one in each of Georgia’s 159 counties, sitting in 51 judicial circuits as the Judicial Council’s FY25 Annual Report counts them. The Council of Superior Court Judges speaks for their judges (its own site was not reachable when this page was composed); the Public Defender Council’s circuit map places each county in its circuit.
  • The state courts — the Council of State Court Judges states: “State Courts are the highest level of county-supported trial court in the State’s judicial branch of government.” and that “Statewide, State Courts are in 72 of Georgia’s 159 counties yet are strategically created to provide access to nearly 80% of the state’s population.”
  • The magistrate courts — in the Council of Magistrate Court Judges’s words, “Magistrate Court is often called the people’s court, because it helps regular citizens represent themselves, without an attorney, in cases against other people. Using the Magistrate Court is quicker, more affordable, and more efficient in cases involving $15,000 or less.”
  • The probate courts — the Council of Probate Court Judges: “In accordance with Article VI, Section I, Paragraph VI of the Georgia Constitution, there is a probate court in each of our state’s 159 counties.” “All of our courts administer wills and estates, appoint and oversee guardians and conservators, and issue marriage and weapons carry licenses. In addition, some of our courts adjudicate traffic offenses and some hear misdemeanor cases.”
  • The juvenile and municipal courts — the Council of Juvenile Court Judges states that “The Council of Juvenile Court Judges is composed of all judges of the courts exercising jurisdiction over juveniles.” and the Council of Municipal Court Judges that “Municipal courts are the busiest courts in Georgia with more than 380 judges managing more than 1,200,000 cases per year.”
  • Court of Appeals of Georgia — the Gateway describes it in one sentence: “The Court of Appeals is the intermediate appellate court.” (the link is the Gateway’s own anchor; the court’s site answered the instrument with a method refusal when this page was composed).

The state is divided into 159 counties, each with a superior court sitting in one of 51 judicial circuits, a probate court and a magistrate court; 72 of them have a state court, in the Council of State Court Judges’ words “State Courts are the highest level of county-supported trial court in the State’s judicial branch of government.” Under § 9-11-4(a) the summons issues from the clerk of the court — the clerks of superior court are served by the Georgia Superior Court Clerks’ Cooperative Authority, “The Georgia Superior Court Clerks’ Cooperative Authority was created by an act of the Georgia General Assembly in 1993.” — and under § 9-11-4(c) process is served by the sheriff or a deputy, the marshal, a person appointed by the court, or a certified process server under § 9-11-4.1: the Georgia Sheriffs’ Association states that “Membership in the Georgia Sheriffs’ Association is comprised of Georgia’s 159 elected sheriffs.” and the Office of Court Professionals that “The Judicial Council adopted rules governing Georgia Certified Process Server (GCPS) program on January 21, 2011. The certification program operates in partnership with the Georgia Sheriffs’ Association and Georgia Sheriffs.”

Appeals lie to the Court of Appeals of Georgia — in the Judicial Council’s words “The Court of Appeals is the intermediate appellate court.” — and above it to the Supreme Court of Georgia, whose Clerk’s office the Court describes as “The Clerk’s office of the Supreme Court of Georgia is the public office of the Court.”

Federal matters arising in Georgia fall within one of three judicial districts under 28 U.S.C. § 90 — the Northern District of Georgia 46 counties in 4 divisions · the Middle District of Georgia 70 counties in 7 divisions · the Southern District of Georgia 43 counties in 6 divisions — and appeals lie to the United States Court of Appeals for the Eleventh Circuit, which states that “Case-related inquiries and non-ECF filings should be directed to the clerk’s principal office in Atlanta.”

For service of process the practical unit is the county: the summons issues from that county’s clerk, the sheriff or a certified process server makes personal service, and under § 9-11-4(h) the proof of service is filed with the court in the county in which the action is pending within five business days.
