Filing fees in the New York Surrogate’s Court are determined according to the specific schedules outlined in Article 24 of the Surrogate’s Court Procedure Act, based on the gross value of the estate stated in the petition. These fees are payable in advance and are exclusive of other statutory provisions unless stated otherwise.
Yes, if the value of the estate as determined later (such as through a tax return or further court proceedings) exceeds the value originally stated in the petition, an additional probate fee must be paid immediately. This additional fee is the difference between the fee for the new value and the fee initially paid.
If the actual value of the estate ends up being less than what was originally stated and paid for, a refund is issued to the estate. The refund equals the difference between the fee initially paid and the fee based on the actual value subsequently shown.
The filing fee for probate or administration generally covers all charges except in cases where the probate is contested. Additional fees are required for actions such as filing objections, demanding a jury trial, or filing a note of issue. Undisputed Legal can help clarify which fees apply to your specific case.
