Service of a summons and complaint in a civil action in the Superior Court of Gwinnett County is governed by O.C.G.A. § 9-11-4, the process section of the Georgia Civil Practice Act, quoted here from Justia’s republication of the 2025 Official Code of Georgia Annotated, the Code published for the State by LexisNexis. Under subsection (a), “Upon the filing of the complaint, the clerk shall forthwith issue a summons and deliver it for service.” Under subsection (b), “The summons shall be signed by the clerk; contain the name of the court and county and the names of the parties; be directed to the defendant.” Subsection (c) names who may serve: “Process shall be served by:” (1) “The sheriff of the county where the action is brought or where the defendant is found or by such sheriff’s deputy;” (2) “The marshal or sheriff of the court or by such official’s deputy;” (3) “Any citizen of the United States specially appointed by the court for that purpose;” (4) “A person who is not a party, not younger than 18 years of age, and has been appointed by the court to serve process or as a permanent process server;” or (5) “A certified process server as provided in Code Section 9-11-4.1.” In Gwinnett County the summons issues from the Clerk of Court, one elected Clerk — “Clerk of Court is an elected position serving the Superior, State, Magistrate, and Juvenile courts in Gwinnett County. The Clerk and Deputy Clerks are custodians over the land and property records of the county as well as the civil and criminal files and records in the courts served.” — whose own fee schedules state “New Civil and Family Cases: $215.00” for the Superior Court, “New Civil Cases: $217.00” for the State Court and “Civil Actions Filing Costs: $60.00 Sheriff Service / each defendant to be served: $50.00 Total + $50.00 for each defendant: $110.00” for the Magistrate Court, and that “E-filing is mandatory for all state and superior civil cases, and optional for magistrate cases and existing state and superior criminal cases” Under O.C.G.A. § 9-11-4(c) Superior Court process is served by the Gwinnett County Sheriff, whose own Civil Process page states “All services require that you complete a Sheriff’s Entry of Service form which is available from any clerk of court within the Gwinnett County Judicial Circuit. Be sure to complete the “Name and Address of Party to Be Served” section.” “You are responsible for determining that the address for service is within Gwinnett County. We do not go outside Gwinnett County to serve a Civil Process.” and its own fee schedule “Fee Schedule (United States currency, money orders, traveler’s checks, or certified bank checks. Foreign currency and personal checks are not accepted): $50 FiFa-Levy $20 FiFa-Nulla Bona $25 FiFa-Nulla Bona – Clerk of Superior Court $50 Out-of-State Service $50 Per Person Service $50 Service of Garnishment or Rule Against Garnishee $25 Service of Dispossessory Proceeding and Notice of Foreclosure $10 Service of In-State Subpoenas $25 Writ of Possession to Evict” (“Civil Processing, Evictions, Drug & Treatment Accountability (770) 822-8200”; “Pay a fee of $25, set by Georgia law, [O.C.G.A.§ 15-16-21(b.)(12)].”); for the Hall County part of the city the serving officer is the Hall County Sheriff, whose Civil office the Georgia Sheriffs’ Association’s 2026 directory lists at “Civil 225 Green St” (“Office 770-531-6900”). Our work in Buford is the service subsection (c) opens to a private server: personal service, the skip trace that locates the defendant, and the documented record of every attempt. The methods are these:

  • Personal Service — Subsection (e) provides that “Except for cases in which the defendant has waived service, the summons and complaint shall be served together.” “The plaintiff shall furnish the clerk of the court with such copies as are necessary.” “Service shall be made by delivering a copy of the summons attached to a copy of the complaint as follows:” and the subsection then sets out, party by party, the person to whom the copy is delivered.
  • Service on a Corporation — Under subsection (e)(1)(A), service on a corporation incorporated or domesticated in Georgia, or a foreign corporation authorized to transact business here, is made “to the president or other officer of such corporation or foreign corporation, a managing agent thereof, or a registered agent thereof,” with the Secretary of State an agent for service when service cannot be had in that manner.
  • Service by Publication — Subsection (f)(1) provides for publication “When the person on whom service is to be made resides outside the state, or has departed from the state, or cannot, after due diligence, be found within the state, or conceals himself or herself to avoid the service of the summons,” on affidavit to the satisfaction of the judge or clerk; then “the judge or clerk may grant an order that the service be made by the publication of summons.”
  • Gated and Secured Communities — Subsection (f)(4) opens gated and secured communities to a person authorized to serve process who identifies the party to be served and displays identification and evidence of appointment; “Any person authorized to serve process shall promptly leave gated and secured communities upon perfecting service of process or upon a determination that process cannot be effected at that time.”
  • Waiver of Service — Subsection (d) provides that “A defendant who waives service of a summons does not thereby waive any objection to the venue or to the jurisdiction of the court over the person of the defendant.” Defendants of the classes it names “have a duty to avoid unnecessary costs of serving the summons,” and a request for waiver allows “at least 30 days from the date on which the request is sent, or 60 days from that date if the defendant is addressed outside any judicial district of the United States”; where a defendant within the United States fails to comply without good cause, “the court shall impose the costs subsequently incurred in effecting service on the defendant unless good cause for the failure is shown.”
  • Territorial Limits and Cumulative Methods — Subsection (g) provides that “All process may be served anywhere within the territorial limits of the state and, when a statute so provides, beyond the territorial limits of the state.” and subsection (j) that “The methods of service provided in this Code section are cumulative and may be utilized with, after, or independently of other methods of service.”

The process and communication to ensure a flawless order by Undisputed Legal put my mind at ease. Brian Ricks has been my POC since I placed the order. Helped to explain how to write a foreign address to make sure it would arrive at its international address. Will update if any changes with service.

After Service in Buford: The Return of Service and Its Filing

O.C.G.A. § 9-11-4 sets out what is recorded and filed after process is served. The statute speaks of the server’s proof of service; in common commercial practice the same record is called an affidavit of service.

The return and its time limit. Subsection (h) provides that “The person serving the process shall make proof of such service with the court in the county in which the action is pending within five business days of the service date.” “If the proof of service is not filed within five business days, the time for the party served to answer the process shall not begin to run until such proof of service is filed.”

The form of the proof. “Proof of service shall be as follows:” (1) “If served by a sheriff or marshal, or such official’s deputy, the affidavit or certificate of the sheriff, marshal, or deputy;” (2) “If by any other proper person, such person’s affidavit;” (3) “In case of publication, the certificate of the clerk of court certifying to the publication and mailing;” or (4) “The written admission or acknowledgment of service by the defendant.” In the case of service otherwise than by publication, “the certificate or affidavit shall state the date, place, and manner of service.”

Amendment. Subsection (i) provides that “At any time in its discretion and upon such terms as it deems just, the court may allow any process or proof of service thereof to be amended, unless it clearly appears that material prejudice would result to the substantial rights of the party against whom the process issued.”

Filing. The proof of service is filed with the court in the county in which the action is pending. For the Superior Court of Gwinnett County that office is the Clerk of Court (“Superior and State Courts (Civil Division) P.O. Box 880 Lawrenceville, GA 30046 770-822-8100”). The Clerk states “E-filing is mandatory for all state and superior civil cases, and optional for magistrate cases and existing state and superior criminal cases”

Buford Area Courts

Buford lies in Gwinnett and Hall Counties, Georgia — a city of two counties (the Census Bureau’s Buford city, its internal point in Gwinnett County, the county of record, its corporate limits reaching into Hall County), not a consolidated government; its courts sit in three tiers: the county courts of Gwinnett County, the statewide appellate courts under the Supreme Court of Georgia, and the federal courts for the Northern District of Georgia, whose Atlanta Division 28 U.S.C. § 90(a)(2) holds at Atlanta. Which court a matter belongs to determines where papers are filed and served; the courts below publish their own sites for filing procedures, locations and rules, and the Georgia Process Service page on this site carries the statewide detail.

  • The Gwinnett County courts — Buford lies in Gwinnett County, the county of record, and in Hall County by the Census Bureau’s own geometry. The Superior Court of Gwinnett County is the county’s trial court of general jurisdiction — “Superior Court is a trial court of general jurisdiction. The court has exclusive, constitutional authority over felony cases, prosecuted by the District Attorney’s Office, regarding title to land, equity, declaratory judgments, habeas corpus, mandamus, quo warranto, prohibition, adoptions, and divorce.” — sitting at the Gwinnett Justice and Administration Center, “75 Langley Dr SW, Lawrenceville, GA 30046” (“phone: 770.822.8100”). Its Clerk, the Clerk of Court, is one elected officer for four courts — “Clerk of Court is an elected position serving the Superior, State, Magistrate, and Juvenile courts in Gwinnett County. The Clerk and Deputy Clerks are custodians over the land and property records of the county as well as the civil and criminal files and records in the courts served.” — whose schedules state “New Civil and Family Cases: $215.00” (“Make checks payable for filing costs to CLERK, SUPERIOR COURT. Out of county service should be paid by separate check payable to the serving official. Any publication cost should be paid by separate check payable to the publisher and submitted to the clerk on filing.”) and “E-filing is mandatory for all state and superior civil cases, and optional for magistrate cases and existing state and superior criminal cases” The State Court of Gwinnett County: “State Court is a trial court with limited jurisdiction covering misdemeanor and traffic violations, prosecuted by the Solicitor’s Office, and all civil actions, regardless of the amount, unless the Superior court has exclusive jurisdiction.” The Magistrate Court of Gwinnett County: “Magistrate Court’s jurisdiction encompasses civil claims of $15,000 or less, county ordinance violations, applications for and issuance of arrest and search warrants, preliminary hearings, dispossessory writs, and distress warrants. No jury trials are held in this court. Appeals from decisions in landlord, tenant and civil cases are made to the Superior and State courts.” (“Gwinnett Justice & Administrative Center 75 Langley Drive Lawrenceville, GA 30046 Monday – Friday 8:00am – 5:00pm Civil Division Clerk’s Office 770-822-8100 Monday – Friday 8:00am – 5:00pm Magistrate, Civil Division 770-822-8088 Monday – Friday 8:00am – 5:00pm”). The Probate Court of Gwinnett County: “Probate Court exercises jurisdiction over: Administration of Estates Marriage License Birth and Death Certificates Probate of Wills Certificates of Residence Temporary and Permanent Guardians of Minors” (“Article 6 Probate Court: Yes”; “General Information: 770-822-8350”). The Gwinnett County Juvenile Court: “Juvenile Court exercises jurisdiction in cases involving delinquent, unruly, dependent, and runaway offenses under the age of 17. Juvenile Court has concurrent jurisdiction with the Superior courts involving capital offenses, custody, child support cases, and termination of parental rights.” (“Gwinnett County Juvenile Court 115 Stone Mountain Street Lawrenceville, GA 30046-6900 770-619-6300 Monday through Friday 8:00 AM – 5:00 PM”). The Gwinnett County Recorder’s Court: “Gwinnett County Recorder’s Court handles traffic citations that are written by the Gwinnett County Police Department, Gwinnett County Sheriff’s Department, Georgia State Patrol, and the Georgia Department of Transportation. Recorder’s Court also handles all Gwinnett County code ordinance violations, such as citations written by Gwinnett County Animal Control, the Planning and Zoning/Inspection Department, the Business License Department, and the Environmental Health Department.” The Buford Municipal Court sits by the City’s own “2026 City of Buford Municipal Court Calendar” — its first line “Friday January 16, 2026 09:00 AM Municipal Court 2300 Buford Hwy.” — and the City’s own page states “you may be required to appear in the Buford City Recorders court”; the county courts’ own Municipal Court Directory lists the court as “Buford Clerk’s Office 2300 Buford Highway Buford, Georgia 30518 (770) 945-6761 Court Hours: Monday – Friday 9:00 AM – 5:00 PM”
  • The Hall County courts, for the Hall County part of Buford — For an address in the Hall County part of the city, civil actions of general jurisdiction are heard by the Superior Court of Hall County, the Northeastern Judicial Circuit’s as the Judicial Council of Georgia’s report titles its judges (“Chief Judge, Northeastern Judicial Circuit, Superior Court”); its own pages answered the instrument with a rate limit when this page was composed. The Hall County Probate Court is an Article 6 probate court by the Council of Probate Court Judges’ own entry (“Select County: Hall Article 6 Probate Court: Yes”). The circuit’s Juvenile Court is titled the same way (“Judge, Northeastern Circuit Juvenile Court”). The Hall County Sheriff’s Office, the serving officer of O.C.G.A. § 9-11-4(c) for that part, is listed by the Georgia Sheriffs’ Association’s 2026 directory at “Address 2859 Browns Bridge Rd” with its Civil office at “Civil 225 Green St” (“Office 770-531-6900”); the City of Buford’s own page lists “Hall County Sheriff’s Office Emergency: 911 Non-Emergency: 770.536.8812” No permitted body read names a State Court or a Magistrate Court of Hall County, so none is named here.
  • The statewide appellate courts — Appeals from both counties’ courts lie to the Court of Appeals of Georgia, which the Judicial Council’s Gateway describes in one sentence: “The Court of Appeals is the intermediate appellate court.” (the link is the Gateway’s own anchor; the court’s site answered the instrument with a method refusal when this page was composed). Above it sits the Supreme Court of Georgia, whose Clerk’s office the Court describes as “The Clerk’s office of the Supreme Court of Georgia is the public office of the Court.”
  • The federal courts — Both counties lie in the Northern District of Georgia, which 28 U.S.C. § 90(a) divides into four divisions. The Gwinnett County part lies in the Atlanta Division, for which 28 U.S.C. § 90(a)(2) provides that “(2) The Atlanta Division comprises the counties of Cherokee, Clayton, Cobb, De Kalb, Douglas, Fulton, Gwinnett, Henry, Newton, and Rockdale. Court for the Atlanta Division shall be held at Atlanta.”: the United States District Court for the Northern District of Georgia sits at Atlanta in the “Street Address: Richard B. Russell Federal Building & United States Courthouse 2211 United States Courthouse 75 Ted Turner Drive, SW Atlanta, GA 30303-3309” — its own page states “The Atlanta division includes the following counties: Cherokee, Clayton, Cobb, DeKalb, Douglas, Fulton, Gwinnett, Henry, Newton and Rockdale.” (“Business Hours: Clerk’s Office: 8:00 a.m. – 4:45 p.m. Monday through Friday, excluding federal holidays”; “404-215-1600”) — and the United States Bankruptcy Court for the Northern District of Georgia keeps its Atlanta office in the same building (“Street Address: Richard B. Russell Federal Building and United States Courthouse 75 Ted Turner Drive, SW Atlanta, GA 30303 Telephone: (404) 215-1000”; “The Clerk’s Office and public intake counter are located on the 13th Floor, Room 1340, and are open to the public from 8:00 am to 4:00 pm, Monday through Friday, excluding court holidays .”), its own page listing the county among those it serves (“Counties Served Cherokee, Clayton, Cobb, DeKalb, Douglas, Fulton, Gwinnett, Henry, Newton, Rockdale”). The Hall County part lies in the Gainesville Division, for which the statute provides that “(1) The Gainesville Division comprises the counties of Banks, Barrow, Dawson, Fannin, Forsyth, Gilmer, Habersham, Hall, Jackson, Lumpkin, Pickens, Rabun, Stephens, Towns, Union, and White. Court for the Gainesville Division shall be held at Gainesville.”: the United States District Court for the Northern District of Georgia, Gainesville Division states “The Gainesville division includes the following counties: Banks, Barrow, Dawson, Fannin, Forsyth, Gilmer, Habersham, Hall, Jackson, Lumpkin, Pickens, Rabun, Stephens, Towns, Union and White.” (“Street Address: Sidney O. Smith Federal Building & United States Courthouse 121 Spring Street SE Room 201 Gainesville, GA 30501-3789”; “Business Hours: Clerk’s Office: 8:00 a.m. – 4:45 p.m. Monday through Friday, excluding federal holidays.”; “678-450-2760”), and the United States Bankruptcy Court, Gainesville office states “Counties Served Banks, Barrow, Dawson, Fannin, Forsyth, Gilmer, Habersham, Hall, Jackson, Lumpkin, Pickens, Rabun, Stephens, Towns, Union, White” (“Street Address: Sidney O. Smith Federal Building and United States Courthouse 121 Spring Street SE, Room 120 Gainesville, GA 30501 Telephone:(404) 215-1000”; “The Clerk’s Office and public intake counter are located on the 1st floor, Room 120, are open to the public from 8:00 am to 4:00 pm, Monday through Friday, excluding court holidays .”). Appeals from both lie to the United States Court of Appeals for the Eleventh Circuit — in its own words “Established by Congress in 1981, the United States Court of Appeals for the Eleventh Judicial Circuit has jurisdiction over federal cases originating in the states of Alabama, Florida and Georgia.”

By the Census Bureau’s own geometry the city’s corporate limits extend from Gwinnett County into Hall County (the Bureau places the city’s internal point in Gwinnett County, the county of record; its polygon overlaps Hall County and no third county), and the City’s own page names both counties’ agencies: “The Marshal’s Office provides assistance to the Gwinnett County Police Department’s North Precinct and the Hall County Sheriff’s Office, who provide the law enforcement services to our citizens, within their respective jurisdictions.” For a serve at an address in the Hall County part, civil actions of general jurisdiction are heard by the Superior Court of Hall County — the Northeastern Judicial Circuit’s, as the Judicial Council’s report titles its judges (“Chief Judge, Northeastern Judicial Circuit, Superior Court”) — whose its own pages answered the instrument with a rate limit when this page was composed; that part’s federal court is held at Gainesville under 28 U.S.C. § 90(a)(1). Under O.C.G.A. § 9-11-4(h) proof of service is filed with the court within five business days of the service date; the Georgia Process Service page on this site carries the statewide detail.

Appeals from both counties’ courts lie to the Court of Appeals of Georgia — in the Judicial Council’s words “The Court of Appeals is the intermediate appellate court.” — and above it to the Supreme Court of Georgia, whose Clerk’s office the Court describes as “The Clerk’s office of the Supreme Court of Georgia is the public office of the Court.”

For federal matters the Gwinnett County part of Buford lies in the Atlanta Division of the Northern District of Georgia under 28 U.S.C. § 90(a)(2), for which court is held at Atlanta: the United States District Court for the Northern District of Georgia states “Street Address: Richard B. Russell Federal Building & United States Courthouse 2211 United States Courthouse 75 Ted Turner Drive, SW Atlanta, GA 30303-3309” (“Business Hours: Clerk’s Office: 8:00 a.m. – 4:45 p.m. Monday through Friday, excluding federal holidays”; “404-215-1600”); the Hall County part lies in the Gainesville Division under 28 U.S.C. § 90(a)(1), for which court is held at Gainesville (“Street Address: Sidney O. Smith Federal Building & United States Courthouse 121 Spring Street SE Room 201 Gainesville, GA 30501-3789”; “Business Hours: Clerk’s Office: 8:00 a.m. – 4:45 p.m. Monday through Friday, excluding federal holidays.”). Appeals lie to the United States Court of Appeals for the Eleventh Circuit, which states that “Case-related inquiries and non-ECF filings should be directed to the clerk’s principal office in Atlanta.”
