Service of Process Methods in North Carolina

Service of a summons and complaint in a civil action in the trial courts of the General Court of Justice — the superior court division and the district court division, whose courts sit in each of North Carolina’s 100 counties — is governed by N.C. Gen. Stat. § 1A-1, Rule 4, the process rule of the North Carolina Rules of Civil Procedure, quoted here from the General Assembly’s own publication of the General Statutes. Under subsection (a), “Upon the filing of the complaint, summons shall be issued forthwith, and in any event within five days.” “The complaint and summons shall be delivered to some proper person for service.” The Rule names who may serve: “In this State, such proper person shall be the sheriff of the county where service is to be made or some other person duly authorized by law to serve summons.” “Outside this State, such proper person shall be anyone who is not a party and is not less than 21 years of age or anyone duly authorized to serve summons by the law of the place where service is to be made.” Under subsection (h1), “If a proper officer returns a summons or other process unexecuted, the plaintiff or his agent or attorney may cause service to be made by anyone who is not less than 21 years of age, who is not a party to the action, and who is not related by blood or marriage to a party to the action or to a person upon whom service is to be made.” The state portal states that “The clerk of superior court is elected to four-year terms and responsible for all clerical and record keeping functions and serves as the judge of probate.” Under G.S. 162-14, “Every sheriff, by himself or his lawful deputies, shall execute and make due return of all writs and other process to him legally issued and directed, within his county” and under G.S. 7A-311 the fee is fixed — “In a civil action or special proceeding, except for actions brought under Chapter 50B of the General Statutes, the following fees and commissions shall be assessed, collected, and remitted to the county” — “For each item of civil process served, including summons, subpoenas, notices, motions, orders, writs and pleadings, the sum of thirty dollars ($30.00).” The North Carolina Sheriffs’ Association states: “We are a statewide 501(c)(3) non-profit association that represents all 100 sheriffs of North Carolina at a state and national level.” Our work across North Carolina is the service the Rule opens to a private server: personal service under subsection (j) once a proper officer has returned the process unexecuted, the skip trace that locates the defendant, and the documented record of every attempt.   • Service on an Agent — Subsection (j)(1)b.: “By delivering a copy of the summons and of the complaint to an agent authorized by appointment or by law to be served or to accept service of process or by serving process upon such agent or the party in a manner specified by any statute.”
  • Registered or Certified Mail — Subsection (j)(1)c.: “By mailing a copy of the summons and of the complaint, registered or certified mail, return receipt requested, addressed to the party to be served, and delivering to the addressee.”
  • Designated Delivery Service — Subsection (j)(1)d. provides for service “By depositing with a designated delivery service authorized pursuant to 26 U.S.C. § 7502(f)(2) a copy of the…” summons and complaint, addressed to the party to be served and delivered to the addressee.
  • Service by Publication — Subsection (j1) provides that “A party that cannot with due diligence be served by personal delivery, registered or certified mail, or by a designated delivery service authorized pursuant to 26 U.S.C. § 7502(f)(2) may be served by publication.” and that “service of process by publication shall consist of publishing a notice of service of process by publication once a week for three successive weeks in a newspaper that is qualified for legal advertising in accordance with G.S. 1-597 and G.S. 1-598”.
  • Service in a Foreign Country — Subsection (j3)(1) provides for service abroad “By any internationally agreed means reasonably calculated to give notice, such as those means authorized by the Hague Convention on the Service Abroad of Judicial and Extrajudicial Documents.”
  • No Service by Email — Subsection (j6) provides that “Nothing in subsection (j) of this section authorizes the use of email for service on the party to be served.”

After Service in North Carolina: The Return of Service and Its Filing

N.C. Gen. Stat. § 1A-1, Rule 4 sets out what is recorded and filed after process is served. The Rule speaks of the return of the summons and of proof of service; in common commercial practice the same record is called an affidavit of service.

The return and its time limit. Subsection (c) provides that “Personal service or substituted personal service of summons as prescribed by Rules 4(j) and (j1) must be made within 60 days after the date of the issuance of summons.” “When a summons has been served upon every party named in the summons, it shall be returned immediately to the clerk who issued it, with notation thereon of its service.” Where a summons is not served on every party within that time, “it shall be returned immediately upon the expiration of such time by the officer to the clerk of the court who issued it with notation thereon of its nonservice and the reasons therefor as to every such party not served.”

Extension. Subsection (d) provides that “When any defendant in a civil action is not served within the time allowed for service, the action may be continued in existence as to such defendant by either of the following methods of extension:” (1) “The plaintiff may secure an endorsement upon the original summons for an extension of time within which to complete service of process.” “Such endorsement may be secured within 90 days after the issuance of summons or the date of the last prior endorsement”; or (2) “The plaintiff may sue out an alias or pluries summons returnable in the same manner as the original process.”

The proof of service. Subsection (j2) provides that “Proof of service of process shall be as follows:” For personal service, “Before judgment by default may be had on personal service, proof of service must be provided in accordance with the requirements of G.S. 1-75.10(a)(1).” For service by registered or certified mail, signature confirmation or a designated delivery service, “the serving party shall file an affidavit with the court showing proof of such service in accordance with the requirements of G.S. 1-75.10(a)(4), 1-75.10(a)(5), or 1-75.10(a)(6), as appropriate.”

Amendment. Subsection (i) provides that “At any time, before or after judgment, in its discretion and upon such terms as it deems just, the court may allow any process or proof of service thereof to be amended, unless it clearly appears that material prejudice would result to substantial rights of the party against whom the process issued.”

Filing. The summons is returned to the clerk who issued it (subsection (c)); the clerk of superior court is the filing office. In the federal courts the United States District Court for the Eastern District of North Carolina states that “Pleadings may be filed in the Office of the Clerk in Raleigh, Greenville, New Bern or Wilmington regardless of the division or judge to which the case is assigned.” the United States District Court for the Middle District of North Carolina that “Filings are not accepted at the Winston-Salem courthouse.” and that “Filings are not accepted at the Durham courthouse.” and the United States District Court for the Western District of North Carolina that “We have offices located in Asheville, Charlotte, and Statesville.” Under G.S. 162-13, “Every sheriff or coroner shall, when requested, give his receipt for all original and mesne process placed in his hands for execution, to the party suing out the same, his agent or attorney.”

Article IV, Section 9 provides that “The General Assembly shall, from time to time, divide the State into a convenient number of Superior Court judicial districts and shall provide for the election of one or more Superior Court Judges for each district.” and that “At least two sessions for the trial of jury cases shall be held annually in each county.” Section 10 provides that “The General Assembly shall, from time to time, divide the State into a convenient number of local court districts and shall prescribe where the District Courts shall sit, but a District Court must sit in at least one place in each county.” The districts themselves are set out in tables in G.S. 7A-41 and G.S. 7A-133. Under Rule 4(b), “The summons shall run in the name of the State and be dated and signed by the clerk, assistant clerk, or deputy clerk of the court in the county in which the action is commenced.” Section 9(3) of Article IV provides that “A Clerk of the Superior Court for each county shall be elected for a term of four years by the qualified voters thereof”. Under Rule 4(a), “In this State, such proper person shall be the sheriff of the county where service is to be made or some other person duly authorized by law to serve summons.” and under G.S. 162-14, “Every sheriff, by himself or his lawful deputies, shall execute and make due return of all writs and other process to him legally issued and directed, within his county”.

Appeals lie to the North Carolina Court of Appeals — the portal: “Established in 1967, the North Carolina Court of Appeals is the state’s intermediate appellate court.” — and above it to the Supreme Court of North Carolina: “The Supreme Court of North Carolina is the state’s highest court, and there is no further appeal from its decisions on matters of state law.”

Federal matters arising in North Carolina fall within one of three judicial districts under 28 U.S.C. § 113: the Eastern District (44 counties and portions of five more; court held at Elizabeth City, Fayetteville, Greenville, New Bern, Raleigh, Wilmington and Wilson); the Middle District (24 counties; court held at Durham, Greensboro and Winston-Salem); the Western District (32 counties; court held at Asheville, Bryson City, Charlotte, Shelby and Statesville). Appeals lie to the United States Court of Appeals for the Fourth Circuit.

For service of process the practical unit is the county: the summons issues from the clerk of superior court of the county in which the action is commenced, the sheriff of the county where service is to be made serves it or a person the Rule names does, and under Rule 4(c) “When a summons has been served upon every party named in the summons, it shall be returned immediately to the clerk who issued it, with notation thereon of its service.” The city and county pages linked from this page carry the local detail.
