Service of Process Methods in Rome, Georgia

Service of a summons and complaint in a civil action in the Superior Court of Floyd County is governed by O.C.G.A. § 9-11-4, the process section of the Georgia Civil Practice Act, quoted here from Justia’s republication of the 2025 Official Code of Georgia Annotated, the Code published for the State by LexisNexis. Under subsection (a), “Upon the filing of the complaint, the clerk shall forthwith issue a summons and deliver it for service.” Under subsection (b), “The summons shall be signed by the clerk; contain the name of the court and county and the names of the parties; be directed to the defendant.” Subsection (c) names who may serve: “Process shall be served by:” (1) “The sheriff of the county where the action is brought or where the defendant is found or by such sheriff’s deputy;” (2) “The marshal or sheriff of the court or by such official’s deputy;” (3) “Any citizen of the United States specially appointed by the court for that purpose;” (4) “A person who is not a party, not younger than 18 years of age, and has been appointed by the court to serve process or as a permanent process server;” or (5) “A certified process server as provided in Code Section 9-11-4.1.” In Floyd County the summons issues from the Clerk of Superior Court — “The Clerk of Superior Court is an elected official charged with the filing and safekeeping of land and property records as well as the civil and criminal files of the court.” — whose own schedule (“FLOYD COUNTY SUPERIOR COURT FEES”) states “General Civil — $213.00, plus applicable service fees.” and dates itself (“The filing fees and court costs enumerated above were effective as of May 12, 2011 but are subject to change as Georgia laws are enacted.”), and whose own page states “Attorneys are now required to electronically file civil proceedings through Odyssey or Peach Court” Under O.C.G.A. § 9-11-4(c) Superior Court process is served by the Floyd County Sheriff, whose own page states “The Floyd County Sheriff’s Office Civil and Court Services Division are responsible for serving Civil Processes, temporary protection orders, Fifa, courthouse security, as well as providing court room security for Superior, Probate, Magistrate, and Juvenile Courts.” (“FCSO – Court Services Division 3 Government Plz Rome, GA 30161 706-314-0712”; “Please give us 12 to 72 hours to respond.”); the Sheriff’s own pages state no fee — the Clerk’s schedule states “Sheriff’s service fees: $50.00” Our work in Rome is the service subsection (c) opens to a private server: personal service, the skip trace that locates the defendant, and the documented record of every attempt. The methods are these:

  • Personal Service — Subsection (e) provides that “Except for cases in which the defendant has waived service, the summons and complaint shall be served together.” “The plaintiff shall furnish the clerk of the court with such copies as are necessary.” “Service shall be made by delivering a copy of the summons attached to a copy of the complaint as follows:” and the subsection then sets out, party by party, the person to whom the copy is delivered.
  • Service on a Corporation — Under subsection (e)(1)(A), service on a corporation incorporated or domesticated in Georgia, or a foreign corporation authorized to transact business here, is made “to the president or other officer of such corporation or foreign corporation, a managing agent thereof, or a registered agent thereof,” with the Secretary of State an agent for service when service cannot be had in that manner.
  • Service by Publication — Subsection (f)(1) provides for publication “When the person on whom service is to be made resides outside the state, or has departed from the state, or cannot, after due diligence, be found within the state, or conceals himself or herself to avoid the service of the summons,” on affidavit to the satisfaction of the judge or clerk; then “the judge or clerk may grant an order that the service be made by the publication of summons.”
  • Gated and Secured Communities — Subsection (f)(4) opens gated and secured communities to a person authorized to serve process who identifies the party to be served and displays identification and evidence of appointment; “Any person authorized to serve process shall promptly leave gated and secured communities upon perfecting service of process or upon a determination that process cannot be effected at that time.”
  • Waiver of Service — Subsection (d) provides that “A defendant who waives service of a summons does not thereby waive any objection to the venue or to the jurisdiction of the court over the person of the defendant.” Defendants of the classes it names “have a duty to avoid unnecessary costs of serving the summons,” and a request for waiver allows “at least 30 days from the date on which the request is sent, or 60 days from that date if the defendant is addressed outside any judicial district of the United States”; where a defendant within the United States fails to comply without good cause, “the court shall impose the costs subsequently incurred in effecting service on the defendant unless good cause for the failure is shown.”
  • Territorial Limits and Cumulative Methods — Subsection (g) provides that “All process may be served anywhere within the territorial limits of the state and, when a statute so provides, beyond the territorial limits of the state.” and subsection (j) that “The methods of service provided in this Code section are cumulative and may be utilized with, after, or independently of other methods of service.”

The process and communication to ensure a flawless order by Undisputed Legal put my mind at ease. Brian Ricks has been my POC since I placed the order. Helped to explain how to write a foreign address to make sure it would arrive at its international address. Will update if any changes with service.

After Service in Rome: The Return of Service and Its Filing

O.C.G.A. § 9-11-4 sets out what is recorded and filed after process is served. The statute speaks of the server’s proof of service; in common commercial practice the same record is called an affidavit of service.

The return and its time limit. Subsection (h) provides that “The person serving the process shall make proof of such service with the court in the county in which the action is pending within five business days of the service date.” “If the proof of service is not filed within five business days, the time for the party served to answer the process shall not begin to run until such proof of service is filed.”

The form of the proof. “Proof of service shall be as follows:” (1) “If served by a sheriff or marshal, or such official’s deputy, the affidavit or certificate of the sheriff, marshal, or deputy;” (2) “If by any other proper person, such person’s affidavit;” (3) “In case of publication, the certificate of the clerk of court certifying to the publication and mailing;” or (4) “The written admission or acknowledgment of service by the defendant.” In the case of service otherwise than by publication, “the certificate or affidavit shall state the date, place, and manner of service.”

Amendment. Subsection (i) provides that “At any time in its discretion and upon such terms as it deems just, the court may allow any process or proof of service thereof to be amended, unless it clearly appears that material prejudice would result to the substantial rights of the party against whom the process issued.”

Filing. The proof of service is filed with the court in the county in which the action is pending. For the Superior Court of Floyd County that office is the Clerk of Superior Court (“Floyd County Superior Court Physical Address: 3 Government Plaza, Suite 101 Rome, GA 30161 Mailing Address: P O Box 1110 Rome, GA 30162 Phone: 706-291-5190 Fax: 706-233-0035”; “Our office hours are 8:00 A.M. until 5:00 P.M. Monday through Friday.”). The Clerk’s own page states “Attorneys are now required to electronically file civil proceedings through Odyssey or Peach Court”

Rome Area Courts

Rome lies in Floyd County, Georgia — a city of the county (the Census Bureau’s Rome city), not a consolidated government; its courts sit in three tiers: the county courts of Floyd County, the statewide appellate courts under the Supreme Court of Georgia, and the federal courts for the Northern District of Georgia, whose Rome Division 28 U.S.C. § 90(a)(3) holds at Rome. Which court a matter belongs to determines where papers are filed and served; the courts below publish their own sites for filing procedures, locations and rules, and the Georgia Process Service page on this site carries the statewide detail.

  • The Floyd County courts — The Superior Court of Floyd County is the county’s trial court of general jurisdiction — in the county’s own words “The superior court, Georgia’s general jurisdiction trial court, has exclusive, constitutional authority to preside over felony cases and cases regarding title to land, divorce and equity.” “Their exclusive jurisdiction also covers such matters as declaratory judgments, habeas corpus, mandamus, quo warrant and prohibition.” — and sits in the Rome Judicial Circuit, which the county’s own page composes as a single-county circuit: “The Rome Circuit, a single county circuit, has the same boundaries as Floyd County and is within the 7th Judicial Administrative District .” (“The Rome circuit serves more than 100,000 people in a 519 square mile area.”). The court sits at “3 Government Plaza Rome, GA 30161 (706) 291-5162” (“This office provides court support to each of our four superior court judges.”). Its Clerk, the Clerk of Superior Court — “The Clerk of Superior Court is an elected official charged with the filing and safekeeping of land and property records as well as the civil and criminal files of the court.” — states “Floyd County Superior Court Physical Address: 3 Government Plaza, Suite 101 Rome, GA 30161 Mailing Address: P O Box 1110 Rome, GA 30162 Phone: 706-291-5190 Fax: 706-233-0035” (“Our office hours are 8:00 A.M. until 5:00 P.M. Monday through Friday.”); its schedule (“FLOYD COUNTY SUPERIOR COURT FEES”) states “General Civil — $213.00, plus applicable service fees.” “Sheriff’s service fees: $50.00” and dates itself: “The filing fees and court costs enumerated above were effective as of May 12, 2011 but are subject to change as Georgia laws are enacted.” The Magistrate Court of Floyd County sits in the Courthouse — “3 Government Plaza Suite 227 Rome, GA 30161 (706)291‑5250” (“Hours Mon 8:15 a.m. to 4:45 p.m.”) — in its own words “Civil cases filed in the Magistrate Court can be for monetary remedies only. Claims must be under $15,000 including contract disputes, personal injury, damage to property and any other civil claims.” “Mediators are present for all civil cases including dispossessories.” and, in its schedule “Floyd County Magistrate Court FEE SCHEDULE – Effective July 1, 2024 (Includes Services Fees – If Applicable)”, “Civil Claim: (Includes service for 1 Defendant) Service for each additional Defendant on Civil cases. Filing fee if served by process server or Defendant acknowledged before filing. $100.00 $50.00 $50.00” The Probate Court of Floyd County: “Probate Court exercises jurisdiction over the following: Probate of Wills Administration of Estates Appointment of Guardians and/or Conservators for Incapacitated Adults Temporary Guardianships of Minors Marriage Licenses Concealed Weapons Carry Permits Traffic Citations issued outside the city limit” (“3 Government Plaza Rome, GA 30161 (706) 291‑5136”; the Council of Probate Court Judges lists “Article 6 Probate Court: Yes”). The Juvenile Court of Floyd County: “The Juvenile Court handles children under the age of seventeen (17) who have been charged with a delinquent offense, sixteen (16) and under who have been charged with a traffic offense, and under the age of eighteen (18) who have deemed to be a dependent child or Children In Need Of Services (CHINS).” (“Juvenile Court 3 Government Plaza Ste. 202 Rome, GA 30161 (706) 291-5180”; “The Floyd County Juvenile Court is located on the 2nd floor of the Floyd County Courthouse/Judicial Center.”). No permitted body read names a Municipal Court of Rome or a State Court of Floyd County — none is named here; the county’s own Board page draws two of its posts “within the corporate limits of the City of Rome”, and the City’s own site was not reachable when this page was composed.
  • The statewide appellate courts — Appeals from the Floyd County courts lie to the Court of Appeals of Georgia, which the Judicial Council’s Gateway describes in one sentence: “The Court of Appeals is the intermediate appellate court.” (the link is the Gateway’s own anchor; the court’s site answered the instrument with a method refusal when this page was composed). Above it sits the Supreme Court of Georgia, whose Clerk’s office the Court describes as “The Clerk’s office of the Supreme Court of Georgia is the public office of the Court.”
  • The federal courts — Floyd County lies in the Rome Division of the Northern District of Georgia, for which 28 U.S.C. § 90(a)(3) provides that “(3) The Rome Division comprises the counties of Bartow, Catoosa, Chattooga, Dade, Floyd, Gordon, Murray, Paulding, Polk, Walker, and Whitfield. Court for the Rome Division shall be held at Rome.”: the United States District Court for the Northern District of Georgia sits at Rome, the page’s own city, in the “Street Address: Harold L. Murphy Federal Building & United States Courthouse 600 East First Street Rome, GA 30161-3149” — its own page states “The Rome division includes the following counties: Bartow, Catoosa, Chattooga, Dade, Floyd, Gordon, Murray, Paulding, Polk, Walker and Whitfield.” (“Business Hours: Clerk’s Office: 8:00 a.m. – 4:45 p.m. Monday through Friday, excluding federal holidays.”; “706-378-4060”) — and the United States Bankruptcy Court for the Northern District of Georgia keeps its Rome office in the same courthouse (“Street Address: United States Courthouse 600 East First Street Rome, GA 30161 Telephone: (404) 215-1000”; “The Clerk’s Office and public intake counter are located on the third floor, Room 339, are open to the public from 8:00 am to 4:00 pm, Monday through Friday, excluding court holidays .”), its own page listing the county among those it serves (“Counties Served Bartow, Catoosa, Chattooga, Dade, Floyd, Gordon, Murray, Paulding, Polk, Walker, Whitfield”). Appeals lie to the United States Court of Appeals for the Eleventh Circuit — in its own words “Established by Congress in 1981, the United States Court of Appeals for the Eleventh Judicial Circuit has jurisdiction over federal cases originating in the states of Alabama, Florida and Georgia.”
