Service of Process Methods in Savannah, Georgia

Service of a summons and complaint in a civil action in the Superior Court of Chatham County is governed by O.C.G.A. § 9-11-4, the process section of the Georgia Civil Practice Act, quoted here from Justia’s republication of the 2025 Official Code of Georgia Annotated, the Code published for the State by LexisNexis. Under subsection (a), “Upon the filing of the complaint, the clerk shall forthwith issue a summons and deliver it for service.” Under subsection (b), “The summons shall be signed by the clerk; contain the name of the court and county and the names of the parties; be directed to the defendant.” Subsection (c) names who may serve: “Process shall be served by:” (1) “The sheriff of the county where the action is brought or where the defendant is found or by such sheriff’s deputy;” (2) “The marshal or sheriff of the court or by such official’s deputy;” (3) “Any citizen of the United States specially appointed by the court for that purpose;” (4) “A person who is not a party, not younger than 18 years of age, and has been appointed by the court to serve process or as a permanent process server;” or (5) “A certified process server as provided in Code Section 9-11-4.1.” In Chatham County the summons issues from the Clerk of Superior Court, which states “There are many ways to file your case in our court.” and “Civil and Family cases can be e-filed in our office at the Public Access Terminals. All Fees are due at the time of service.”; its Civil Division Fee Schedule (“Effective July 1, 2024”) lists “General Civil and Domestic (Plus Applicable Service Fee) $218.00”. Under O.C.G.A. § 9-11-4(c) Superior Court process is served by the Chatham County Sheriff, whose own mission page lists “Properly receiving and serving civil processes and subpoenas and order from the Probate, Magistrate, State, and Superior Courts;” (“Street Operations Civil: (912) 652-7630 (912) 652-7631”; “Street Operations, both Civil and Criminal numbers, are for weekdays only.”); the Sheriff’s own pages state no fee — the Clerk of Superior Court’s schedule lists “For Sheriff’s Service (plus cost of copies of documents to be served.) $50.00 +$.50/Page”. Our work in Savannah is the service subsection (c) opens to a private server: personal service, the skip trace that locates the defendant, and the documented record of every attempt. The methods are these:

  • Personal Service — Subsection (e) provides that “Except for cases in which the defendant has waived service, the summons and complaint shall be served together.” “The plaintiff shall furnish the clerk of the court with such copies as are necessary.” “Service shall be made by delivering a copy of the summons attached to a copy of the complaint as follows:” and the subsection then sets out, party by party, the person to whom the copy is delivered.
  • Service on a Corporation — Under subsection (e)(1)(A), service on a corporation incorporated or domesticated in Georgia, or a foreign corporation authorized to transact business here, is made “to the president or other officer of such corporation or foreign corporation, a managing agent thereof, or a registered agent thereof,” with the Secretary of State an agent for service when service cannot be had in that manner.
  • Service by Publication — Subsection (f)(1) provides for publication “When the person on whom service is to be made resides outside the state, or has departed from the state, or cannot, after due diligence, be found within the state, or conceals himself or herself to avoid the service of the summons,” on affidavit to the satisfaction of the judge or clerk; then “the judge or clerk may grant an order that the service be made by the publication of summons.”
  • Gated and Secured Communities — Subsection (f)(4) opens gated and secured communities to a person authorized to serve process who identifies the party to be served and displays identification and evidence of appointment; “Any person authorized to serve process shall promptly leave gated and secured communities upon perfecting service of process or upon a determination that process cannot be effected at that time.”
  • Waiver of Service — Subsection (d) provides that “A defendant who waives service of a summons does not thereby waive any objection to the venue or to the jurisdiction of the court over the person of the defendant.” Defendants of the classes it names “have a duty to avoid unnecessary costs of serving the summons,” and a request for waiver allows “at least 30 days from the date on which the request is sent, or 60 days from that date if the defendant is addressed outside any judicial district of the United States”; where a defendant within the United States fails to comply without good cause, “the court shall impose the costs subsequently incurred in effecting service on the defendant unless good cause for the failure is shown.”
  • Territorial Limits and Cumulative Methods — Subsection (g) provides that “All process may be served anywhere within the territorial limits of the state and, when a statute so provides, beyond the territorial limits of the state.” and subsection (j) that “The methods of service provided in this Code section are cumulative and may be utilized with, after, or independently of other methods of service.”

After Service in Savannah: The Return of Service and Its Filing

O.C.G.A. § 9-11-4 sets out what is recorded and filed after process is served. The statute speaks of the server’s proof of service; in common commercial practice the same record is called an affidavit of service.

The return and its time limit. Subsection (h) provides that “The person serving the process shall make proof of such service with the court in the county in which the action is pending within five business days of the service date.” “If the proof of service is not filed within five business days, the time for the party served to answer the process shall not begin to run until such proof of service is filed.”

The form of the proof. “Proof of service shall be as follows:” (1) “If served by a sheriff or marshal, or such official’s deputy, the affidavit or certificate of the sheriff, marshal, or deputy;” (2) “If by any other proper person, such person’s affidavit;” (3) “In case of publication, the certificate of the clerk of court certifying to the publication and mailing;” or (4) “The written admission or acknowledgment of service by the defendant.” In the case of service otherwise than by publication, “the certificate or affidavit shall state the date, place, and manner of service.”

Amendment. Subsection (i) provides that “At any time in its discretion and upon such terms as it deems just, the court may allow any process or proof of service thereof to be amended, unless it clearly appears that material prejudice would result to the substantial rights of the party against whom the process issued.”

Filing. The proof of service is filed with the court in the county in which the action is pending. For the Superior Court of Chatham County that office is the Clerk of Superior Court (“Monday – Friday, 8:00 am to 5:00 pm. Our Civil Division is located at 400 W. Oglethorpe Avenue, Suite 178, Savannah, GA 31401.”). The Clerk states “Civil and Family cases can be e-filed in our office at the Public Access Terminals. All Fees are due at the time of service.” and the State Court that “All civil filings must be electronically filed via eFileGA.”

Savannah Area Courts

Savannah lies in Chatham County, Georgia — a city of the county (the Census Bureau’s Savannah city), not a consolidated government; its courts sit in three tiers: the county courts of Chatham County, the statewide appellate courts under the Supreme Court of Georgia, and the federal courts for the Southern District of Georgia, whose Savannah Division 28 U.S.C. § 90(c)(3) holds at Savannah. Which court a matter belongs to determines where papers are filed and served; the courts below publish their own sites for filing procedures, locations and rules, and the Georgia Process Service page on this site carries the statewide detail.

  • The Chatham County courts — The Superior Court of Chatham County is the county’s trial court of general jurisdiction — “The Superior Courts of the State of Georgia are the trial courts of general jurisdiction which means that the Superior Courts hear criminal, civil, equity and family law cases.” “The Superior Court of Chatham County is composed of six (6) judges who are elected by the citizens of Chatham County to a term of four (4) years.” It sits at the “Coleman Courthouse 133 Montgomery Street Savannah, Georgia 31401” and its circuit is the county alone: “The Eastern Judicial Circuit is comprised solely of Chatham County, Georgia which includes the cities of Savannah, Tybee Island, Pooler, Garden City, Port Wentworth, Bloomingdale, Thunderbolt, and Vernonburg.” Its Clerk, the Clerk of Superior Court, keeps the civil record (“Monday – Friday, 8:00 am to 5:00 pm. Our Civil Division is located at 400 W. Oglethorpe Avenue, Suite 178, Savannah, GA 31401.”; “(912) 434-8920”). The State Court of Chatham County: “With respect to CIVIL matters, the Court enjoys concurrent jurisdiction with the Superior Courts, without regard to a dollar amount, except for those actions where exclusive jurisdiction is vested in the Superior Courts.” “All civil filings must be electronically filed via eFileGA.” (“Suite 127 400 W. Oglethorpe Avenue Savannah, Georgia 31401”; “Phone: (912) 652-7224, Option 3”). The Magistrate Court of Chatham County: “Magistrate Court’s jurisdiction includes civil claims of $15,000.00 or less, dispossessory proceedings (landlord/tenant), applications for and the issuance of arrest and/or search warrants and preliminary hearings.” “The Magistrate Court does not hold jury trials and is not a court of record. Any appeals from judgments in civil cases are made to the Superior and State Courts.” (“Civil Suit $53.00 Civil Suit Service per Defendant $50.00”; “133 Montgomery St., Rm. 509 Savannah, GA 31401-3242”; “Main Phone: (912) 652-7264”). The Chatham County Probate Court: “Chatham County Probate Court is an Article 6 Court which means that the court has expanded jurisdiction under Article 6, Title 15, Chapter 9 of the Official Code of Georgia due to the population size of the county.” The Chatham County Juvenile Court: “The Juvenile Court is responsible for handling all delinquent complaints concerning children who are under the age of 17 years.” (“CHATHAM COUNTY JUVENILE COURT 197 Carl Griffin Dr Savannah, Georgia 31405”). The Recorder’s Court of Chatham County holds the municipal-court role for Savannah under the county courts’ own Municipal Courts listing — “Municipal Courts The Recorder’s Court of Chatham County Chatham County Courthouse, 1st Floor. 133 Montgomery Street, Savannah GA 31401 Phone: 912-652-7425” (“Office Hours: 8:15 AM – 5:00 PM”) — the State Court’s phrase for it a “court of inquiry (Recorder’s Court or Municipal Court)”; its own City-hosted page was not reachable when this page was composed.
  • The statewide appellate courts — Appeals from the Chatham County courts lie to the Court of Appeals of Georgia, which the Judicial Council’s Gateway describes in one sentence: “The Court of Appeals is the intermediate appellate court.” (the link is the Gateway’s own anchor; the court’s site answered the instrument with a method refusal when this page was composed). Above it sits the Supreme Court of Georgia, whose Clerk’s office the Court describes as “The Clerk’s office of the Supreme Court of Georgia is the public office of the Court.”
  • The federal courts — Chatham County lies in the Savannah Division of the Southern District of Georgia, for which 28 U.S.C. § 90(c)(3) provides that “(3) The Savannah Division comprises the counties of Bryan, Chatham, Effingham, and Liberty. Court for the Savannah Division shall be held at Savannah.”: the United States District Court for the Southern District of Georgia keeps its Savannah office at “Street Address: 8 Southern Oaks Ct. Savannah, GA 31405” (“Mailing Address: 124 Barnard Street Savannah, GA 31401 Clerk’s Office 912-650-4020”) and states “The U.S. District Court is comprised of 6 divisions encompassing 43 counties in the State of Georgia.”; the United States Bankruptcy Court for the Southern District of Georgia sits in the same city (“Street Address: U.S. Bankruptcy Court 124 Barnard Street, Second Floor Savannah, GA 31401 (912) 650-4100”; “Clerk’s Office Hours of Operation: Monday through Friday, 8:30 AM to 5:00 PM”) — its own pages assign counties to divisions only in a map (“Click here to view a map of Southern District of Georgia counties and assigned divisions…”), so the county’s division rests on the statute above. Appeals lie to the United States Court of Appeals for the Eleventh Circuit — in its own words “Established by Congress in 1981, the United States Court of Appeals for the Eleventh Judicial Circuit has jurisdiction over federal cases originating in the states of Alabama, Florida and Georgia.”

All Fees are due at the time of service.” and (“Effective July 1, 2024”) lists “General Civil and Domestic (Plus Applicable Service Fee) $218.00”.
