How UIDDA Works

Under the UIDDA, litigants seeking discoverable materials from another state can present a subpoena issued by a court in the trial state to a clerk of the court in the state where the materials are located. Upon receipt of the foreign subpoena, the clerk will issue a corresponding subpoena for service upon the person or entity directed by the original subpoena. The terms of the issued subpoena mirror those of the original, and it must include contact information for all counsel of record and any unrepresented parties.

One of the key benefits of the UIDDA is that it minimizes judicial oversight, eliminating the need for obtaining a commission or local counsel in the discovery state, letters rogatory, or filing a miscellaneous action during the discovery phase of litigation.
