The summons must bear the clerk’s signature, the court’s seal, the names of the court and the parties, be addressed to the defendant, and include the name and address of the plaintiff’s attorney (if any; otherwise, the plaintiff’s address), specify the time frame within which the defendant must appear and defend, and inform the defendant that if they fail to do so, judgment by default will be entered against the defendant.

All legal papers must be served by a law enforcement official, a person designated by the Commissioner of Public Safety, or, if required by law, by registered or certified mail. When attempting to serve legal documents, a process server may face physical resistance or obstruction, in which case the process server may seek the help of a peace officer. When considerable savings in travel fees and expenditures may be achieved via the use of special appointments for the serving of all process other than such appointments may be established without charge.

Service of process may be made on an individual by hand delivering a copy of the summons and complaint to the individual,  by leaving copies at the individual’s residence or usual place of abode with some person of suitable age and discretion then residing therein, or by hand delivering a copy of the summons and complaint to an agent authorized by appointment or by law to receive service of process.

 Service on a party located outside of the state shall be made in the same manner as if it were made within the state, except that service shall be made by a sheriff, constable, bailiff, peace officer, or other officer having like authority and jurisdiction where service is made, or by a person specifically appointed by the court to do service.

Summons sent to the defendant, a copy of the completed and signed complaint, and a self-addressed, postage-paid envelope will all be provided.

3. When used in these regulations, the term ‘peace officer’ refers to any member of the state police, the police force of any incorporated city, village, or borough, the United States Marshals and their deputies, other officers whose duty is to enforce and preserve the public peace, and, within the authority conferred upon them, persons specially appointed pursuant to paragraph (3) of this subdivision.

4. Only after a thorough investigation of each applicant will the Commissioner of Public Safety make special appointments for the service of all processes relating to remedies for the seizure of persons or property pursuant to Rule 64 or for the service of process to enforce a judgment by writ of execution. Such appointment may be made subject to such conditions as appear proper in the Commissioner’s discretion for the public’s protection.

5. The public safety commissioner is responsible for ensuring that all orders issued by the state’s highest court and subordinate state courts are properly served according to AS 22.20. Rules 4(c)(3) and 45 of the Rules of Civil Procedure and Rule 17 of the Rules of Criminal Procedure make clear that the commissioner may appoint or designate private individuals to serve legal documents on behalf of the court. In accordance with AS 22.20.120, a civilian process server is a private citizen authorized to serve the process by possessing a license obtained under this chapter. To ensure that civilian service of process is carried out in accordance with the rules of the supreme court and in a manner that protects the public, the provisions of 067.010-067.990 address the application and licensing requirements, disciplinary guidelines, and standards of professional conduct that the commissioner deems necessary.

6. When the individual hires a process server, they must make payment arrangements. If the person is going to engage a process server, they will need to fill out Service Instructions, CIV 615 PDF, and hand it over to them with the copies. A Proof of Service form will be sent to them when the process server has completed service. In order to get confirmation of service from a process server located outside of Alaska, the individual must give them a completed Return of Service, SHC 193. To verify that the plaintiff has served the defendant, they will need to save the Proof of Service or Return of Service form.
